Plan to develop the Penal Code project (amended)

Develop and complete the Criminal Code project dossier to ensure proper order and procedures.

The purpose of the Plan is to conduct a comprehensive review and assessment of the practical implementation of the 2015 Penal Code (amended and supplemented in 2017, hereinafter referred to as the Penal Code); based on the practical situation, difficulties and obstacles in implementing the Penal Code to develop appropriate regulations, consistent with the provisions of relevant laws, meeting practical requirements; contributing to improving the effectiveness of the fight against crime, maintaining social order and safety in the new situation. Refer to and selectively absorb legal experience and criminal work practices of a number of countries in the world in accordance with the practical conditions of Vietnam, laws, practices and international treaties to which Vietnam is a member.

The contents of the Criminal Code project, when being built, must be placed within the overall policies and guidelines of the Party and State on criminal law; requirements for building a socialist rule-of-law state, judicial reform, administrative reform; and compliance with the provisions of the Constitution.

Based on the difficulties and obstacles in the implementation of the Penal Code and the requirements of the fight against crime in the new situation, to propose appropriate amendments and supplements, selectively absorb the experience of building criminal laws of countries with advanced legislative levels in the world, especially countries with similarities with Vietnam in politics and law; research, develop and complete the dossier of the Penal Code project to ensure compliance with the order and procedures prescribed by the Law on Promulgation of Legal Documents.

Contents of the Plan

The content of the Plan is to organize the development of the Criminal Code (amended) project in accordance with the provisions of the Law on Promulgation of Legal Documents 2025 and Resolution No. 190/2025/QH15 dated February 19, 2025 of the National Assembly regulating the handling of a number of issues related to the reorganization of the state apparatus. It is expected to be submitted to the National Assembly for consideration, comments, and approval of the Criminal Code (amended) project according to the shortened procedures at the 10th session of the 15th National Assembly (October 2025).

At the same time, organize a summary of the practice of 8 years of implementing the Penal Code, including: Comprehensive and in-depth summary of the practice of 8 years of implementing the Penal Code in the People's Public Security, the People's Army, in the system of People's Courts, People's Procuracy and relevant ministries, branches, agencies, People's Committees of provinces and centrally run cities; at the same time, analyze and evaluate the results of implementing the provisions of the Penal Code, recommend specific contents that need to be amended and supplemented.

Summarize and evaluate the results of the implementation of the Penal Code as well as evaluate the situation of law violations in general and crimes in particular related to the fields managed by ministries, branches and agencies; which violations are required to be handled criminally by relevant international treaties but are not yet regulated in the Penal Code; evaluate the new situation and requirements, thereby proposing and recommending specific contents of the Penal Code that need to be amended and supplemented; summarize and evaluate the results of the implementation of the Penal Code as well as evaluate the situation of law violations in general and crimes in particular in the provinces and centrally run cities; evaluate the new situation and requirements, thereby proposing and recommending specific contents of the Penal Code that need to be amended and supplemented.

Another content of the Plan is to organize the drafting of sections and chapters in the draft Penal Code (amended) to synthesize and serve the development of the Penal Code (amended) project. The Plan assigns specific tasks to the Ministry of Public Security, the Ministry of Justice, the Ministry of National Defense and requests the People's Court and the People's Procuracy to draft sections and chapters in the draft and send them to the Ministry of Public Security before April 10, 2025 for synthesis. The Ministry of Public Security shall preside over and coordinate with relevant ministries, branches and agencies to take full responsibility for the progress, content and quality of the draft sections and chapters in the draft Penal Code (amended).
