The Prime Minister issued a Plan to develop the Penal Code project (amended)

Thủ tướng Chính phủ ban hành Kế hoạch xây dựng dự án Bộ luật Hình sự (sửa đổi)- Ảnh 1. — The draft Penal Code (amended) is expected to be submitted to the 16th National Assembly for consideration and comments at the 3rd session (expected in May 2027) and approved at the 4th session (expected in October 2027).

The purpose of issuing the Plan is to institutionalize the Party's policies and guidelines and the Constitution, ensuring that the content of the Penal Code is consistent with the spirit of judicial reform. Perfecting the national criminal policy, building a unified, synchronous, transparent and feasible criminal law system to meet the requirements of fighting and preventing crime in the new situation; contributing to preventing and combating corruption and negativity in judicial activities. Ensuring human rights, civil rights, innovating criminal legislation thinking in a humane direction, protecting basic rights, expanding non-criminal handling measures. At the same time, in accordance with international practices and international integration, updating and absorbing international legal standards, better serving the integration process and international cooperation in crime prevention and combat.

The plan includes three main contents: (1) Implementing the development of the Penal Code project (amended); (2) Organizing the summary of the implementation of the Penal Code; (3) Organizing the development of draft sections and chapters in the draft Penal Code (amended).

The Ministry of Public Security is fully responsible for the progress, content, and quality of the draft sections, chapters, and articles in the draft Penal Code (amended).

Regarding the organization of drafting sections and chapters in the draft Penal Code (amended), the Prime Minister assigned:

The Ministry of Public Security shall preside over and coordinate with relevant ministries, branches, localities and agencies to organize the development and take full responsibility for the progress, content and quality of the draft sections, chapters and articles in the draft Penal Code (amended); at the same time, develop the Part on general provisions (chapters I to XII); Chapter XIII. Crimes against national security; Chapter XIX. Environmental crimes; Chapter XX. Drug crimes; Chapter XXI. Crimes against public safety and public order; Chapter XXII. Crimes against administrative management order.

The Ministry of National Defense drafted Chapter XXV. Crimes against the duties and responsibilities of military personnel and the responsibilities of those attached to the Army in combat; drafted Chapter XXVI. Crimes against peace, crimes against humanity and war crimes.

The Ministry of Justice drafted Chapter XVII. Crimes against the marriage and family regime.

The Prime Minister requested the Supreme People's Court to draft Chapter XIV. Crimes against human life, health, dignity, and honor; draft Chapter XVI. Crimes against property; draft Chapter XVIII. Crimes against economic management order.

Propose that the Supreme People's Procuracy draft Chapter XV. Crimes against human rights, democratic rights and freedoms of citizens; draft Chapter XXIII. Crimes against positions; draft Chapter XXIV. Crimes against judicial activities.

In addition to the above-mentioned expected assigned contents, ministries and branches, in the process of implementing the Penal Code, may propose additional amendments and supplements to the Penal Code to suit the practical situation.

Complete the draft Penal Code (amended) and submit it to the National Assembly for consideration and comments in March 2027

The Ministry of National Defense, the Ministry of Justice, the Supreme People's Procuracy, the Supreme People's Court and other ministries, branches and agencies shall draft sections and chapters in the draft Code and send them to the Ministry of Public Security before February 1, 2026 for synthesis to serve the development of the revised Penal Code project.

The Ministry of Public Security synthesizes the construction results of relevant ministries, branches and agencies; researches and builds the project dossier of the Penal Code (amended) according to the order and procedures of the Law on Promulgation of Legal Documents. To be completed before June 2026.

During the process of developing the Penal Code (amended) project, the Ministry of Public Security presided over the survey, consulted experiences and widely collected opinions on the Code project. The collection of opinions was conducted in writing and conferences and seminars were organized to collect opinions from ministries, branches, People's Committees of provinces and cities, relevant agencies, organizations and individuals. At the same time, the Penal Code (amended) project was posted on the National Law Portal, the Government's Electronic Information Portal, and the Ministry of Public Security's Electronic Information Portal to collect public opinions in July 2026.

The Ministry of Public Security shall preside over and coordinate with ministries, branches, localities and relevant agencies and units to complete the draft Penal Code (amended) and submit it to the National Assembly for consideration and comments at the 3rd session of the 16th National Assembly (in March 2027) and submit it to the National Assembly for approval at the 4th session of the 16th National Assembly (in August 2027).
