On the morning of October 10, the Ho Chi Minh City National Assembly Delegation held a policy consultation conference on four draft laws: the Law on Digital Transformation, the Law on High Technology (amended), the Law on amending and supplementing a number of articles of the Law on Technology Transfer, and the Law on amending and supplementing a number of articles of the Law on Intellectual Property.

Comrade Nguyen Van Loi, member of the Party Central Committee, Head of the National Assembly Delegation of Ho Chi Minh City chaired the conference. Attending the conference were Comrade Duong Anh Duc, member of the Standing Committee of the City Party Committee, Head of the Propaganda and Mass Mobilization Commission of the City Party Committee.
Unifying policies for technology businesses
In his speech, comrade Duong Anh Duc raised many practical problems that Ho Chi Minh City encountered in the process of implementing regulations related to high technology and digital transformation.
Accordingly, the Law on Information Technology was issued first, followed by the Law on High Technology, leading to interference and overlap, especially in the content related to software technology parks and concentrated information technology parks.
From his practical experience working at the Ho Chi Minh City People's Committee, he shared that the city had a hard time explaining and proposing that software technology units, if located in Quang Trung Software Park or concentrated technology zones in Da Nang , would enjoy full policies of the high-tech zone. Because when investing in software technology, enterprises in the high-tech zone enjoy incentives, but the same enterprises located in the software park do not. That is a lack of unity that needs to be overcome.
He suggested that in the transitional provisions of the Law on High Technology (amended), there should be regulations ensuring that zones in the fields of software technology or information technology and other fields of similar nature enjoy the same policies to ensure fairness.
Regarding the draft Law on Digital Transformation (amended), comrade Duong Anh Duc proposed to add more clear provisions on prohibited acts. Specifically, the use of digital technology to defraud and appropriate property, spread fake news using deepfake, AI, etc. has been mentioned. However, the draft law only states "violation of the law", which is not enough. Therefore, it is necessary to have specific definitions of common acts that have a great impact on social life so that enforcement agencies can easily apply and handle them.

Let digital data create value
Director of the Ho Chi Minh City Digital Transformation Center Vo Thi Trung Trinh analyzed that the Law on Digital Transformation was built in the context of Vietnam implementing Resolution 57 on science and technology development, innovation and digital transformation, and at the same time implementing a 2-level local government model.
Therefore, the Law on Digital Transformation must be placed within the overall system of related laws including the Law on Data, the Law on Information Security and the Law on Cyber Security, because these three contents cannot be separated. When all activities are brought to the digital environment, people's digital trust can only be formed if data and information are absolutely secure, helping them feel secure in conducting administrative, civil and economic transactions online.
In addition, the nature of digital transformation is data. If the Digital Transformation Law does not clarify the content of data, but only stops at civil administrative regulations, it will not be possible to form a data economy. At that time, digital transformation only stops at the level of technology application, not creating new value.
He also noted that the national digital data architecture framework is only truly valuable when there is a substantial, complete and standardized data system. Without the data element, the architecture framework is only on paper and has no practical value.

Head of the Ho Chi Minh City National Assembly Delegation Nguyen Van Loi shared that the National Assembly's organization to collect opinions on the above four draft laws is of special importance in the context that the whole country is implementing Resolution 57 of the Politburo. Therefore, the goal of this conference to collect opinions is to listen to the opinions of experts, scientists, businesses... so that the draft laws can truly come into life.
