Ms. Nguyen Thi Hang, permanent resident of house number 139A Bui Huu Nghia street, ward 1 (Binh Thanh district, Ho Chi Minh City) submitted a petition to SGGP Newspaper about the fact that her two houses number 139A and 139/4 Bui Huu Nghia street were completely built, in accordance with the permit, but after 2 years of waiting, they still have not been completed.

According to Ms. Hang, at the end of December 2021, the Urban Management Department (Urban Management) of Binh Thanh District inspected the construction of the above two houses. The inspection report did not record any data confirming that her house was built without permission. However, a few days later, an officer of the Urban Management Department called to inform that Ms. Hang's house was built without permission. Ms. Hang requested a re-inspection to determine which items were wrong and issue a specific document to correct them. In February 2022, Ms. Hang received Official Letter No. 407/CNBTH from the Ho Chi Minh City Land Registration Office, Binh Thanh District Branch.

The document clearly states: “According to Document No. 33/QLDT dated January 10, 2022 of the Department of Investment Management of Binh Thanh District: the project has been completed and put into use with a scale of 3 floors and a stair canopy. Specifically: building an additional stair canopy with an actual area of: 7.4m x 3.4m = 25.16m2; the house has an area within the 2m alley road boundary that is not granted a construction permit; the house has sliding windows on the 2nd and 3rd floors behind the adjacent house (not ensuring the distance between the land plot boundary and the boundary of the adjacent house is 2m or more). Propose to handle the above violations. Therefore, the competent authority has no basis to consider recognizing the house ownership as requested by her according to regulations”. Disagreeing with the above results, Ms. Hang filed a complaint to the authorities of Ho Chi Minh City.

In September 2023, Chairman of Binh Thanh District People's Committee Dinh Khac Huy chaired a meeting with Ms. Hang and her husband. After listening to Ms. Hang and her husband's presentation on the completion of the construction project, Chairman of Binh Thanh District People's Committee Dinh Khac Huy assigned the district inspector to preside over and coordinate with relevant agencies and units to organize inspection and measurement under the witness of the project owner. Assign the Department of Construction Management to carry out the work before September 30, 2023.

Inspect and report to the People's Committee of Binh Thanh District for construction parts that are not in accordance with the permit but are in accordance with and not in accordance with Decision No. 56/2021/QD-UBND dated December 28, 2021 of the People's Committee of Ho Chi Minh City... request the investor to remedy. Coordinate with the People's Committee of Ward 1 to inspect and report to the People's Committee of Binh Thanh District for construction parts that are not in accordance with the alley road permit, determine whether the construction part within the road is a fence or a house wall, the structure, and must consider landscape factors and fire prevention and fighting safety.

After receiving the report, the district inspectorate will synthesize and advise the People's Committee of Binh Thanh District to send a written notice to Ms. Hang and her husband before October 15, 2023. On September 13, 2023, Vice Chairman of Ward 1 People's Committee Nguyen Vien Tinh signed Report No. 399/UBND proposing the handling of violations of construction order at the construction site No. 139A and 139/4 Bui Huu Nghia Street. Accordingly, the temporary iron frame will be installed to protect against theft and the District People's Committee will be recommended to consider allowing the area belonging to the 2m alley due to its temporary structure and there is currently no policy to expand the alley.

At the same time, it is recommended that the District People's Committee review the planning of alley 139 Bui Huu Nghia. The roof of the staircase is made of brick walls and tiled roofs. It is recommended that the District People's Committee review the planning of the area and landscape elements. According to the conclusion of the meeting between the Chairman of the People's Committee of Binh Thanh District and Ms. Hang and her husband, the District Inspectorate synthesized and advised the People's Committee of Binh Thanh District to send a written notice to Ms. Hang and her husband before October 15, 2023. However, it is now the end of November 2023, but Ms. Hang and her husband have not yet received the document.
