(Dan Tri) - Citing the years-long process of resolving the gun emplacements at Tan Son Nhat airport, Major General Le Tan Toi proposed a mechanism to resolve the conflict between defense-security land planning and socio-economic planning.

On the morning of October 14, the National Assembly Standing Committee gave opinions on the Draft Law on Amended Planning, with a number of new points related to the completion of regulations on the planning system, the relationship between types of planning and the handling of conflicts between planning.

This bill has 6 chapters, 58 articles and 1 appendix, expected to be submitted to the National Assembly for consideration and approval at the session next October.

Handling conflicts between plans, ensuring implementation of investment projects

Deputy Minister of Finance Tran Quoc Phuong said the draft law has added regulations to handle conflicts between plans approved by different levels, for example between regional plans, provincial plans and sectoral plans and detailed sectoral plans or conflicts between plans at the same level.

“Regulations on handling conflicts between plans are built to ensure that investment projects can be implemented in the shortest time after determining the applicable plan, promptly meeting practical requirements,” said Mr. Phuong.

Deputy Chairman of the Economic and Financial Committee Nguyen Ngoc Bao said the review agency proposed to continue researching and perfecting the Planning List to ensure consistency, connectivity, feasibility and stability.

The Economic and Financial Committee also proposed a separate handling mechanism for cases where conflicts between plans are discovered, including strict control to avoid arbitrariness, abuse, disruption of socio-economic activities, and impacts on the legitimate rights and interests of the State, people, and businesses.

Discussing this content, Chairman of the National Defense - Security and Foreign Affairs Committee Le Tan Toi noted that the draft law has added content on planning for national defense and security land use, clearly stipulating the need to differentiate between national defense and security land use periods.

Concerned about the conflict between national defense and security land planning and socio-economic development and investment planning, Mr. Toi said that this is a problem with many obstacles, and when resolved, it is costly and time-consuming.

As an example, the Chairman of the National Defense - Security and Foreign Affairs Committee mentioned that it took years to resolve the gun emplacements at Tan Son Nhat airport and "it was only completed when the Prime Minister came in to resolve it."

From that reality, Mr. Toi proposed to study and include the content of handling this conflict in the law so that the Government can provide specific regulations, both harmonizing socio-economic development, ensuring investment for national development, and ensuring national defense and security.

"Don't try too hard"

Vice Chairman of the National Assembly Nguyen Khac Dinh assessed this law as very difficult, complicated and "still very comprehensive".

Regarding sectoral planning, the Vice Chairman of the National Assembly said that previously there were opinions that more than 20,000 plans were too many and had to be put forward, but now they were put forward to decentralize to the minister. "If so, the transport sector will just let this land be planned for transport, and the irrigation sector will let this land be planned for irrigation," Mr. Dinh pointed out the unreasonableness.

According to him, national planning must be decided by the National Assembly, while sectoral planning must be approved by the Government. Emphasizing that planning is very important and is the lifeblood of the economy, Mr. Dinh stated that there are things that cannot be decentralized.

“What can be decentralized is decentralized, but there are also things that are “absolutely not decentralized”. If sector planning is left to the ministers to decide, then each minister will be in charge of a sector, and each minister will only care for his own sector,” according to the Vice Chairman of the National Assembly.

The Vice Chairman of the National Assembly also suggested that law amendments should focus on things that really need to be changed, and should not be too comprehensive or detailed.

Deputy Prime Minister Nguyen Chi Dung said that implementing the direction of the Politburo, the Government proposed to amend the Law on Comprehensive Planning to remove obstacles, contradictions, conflicts, and bottlenecks.

Concluding the session, Vice Chairman of the National Assembly Vu Hong Thanh suggested clearly defining which law is of principle nature so that other laws can be adjusted accordingly, avoiding conflicts and overlaps in practice. At the same time, it is necessary to complete the planning list in the planning system, clearly defining the role of each type of planning.

According to the Vice Chairman of the National Assembly, it is necessary to clearly distinguish between strategic, long-term planning serving policy making and planning as a specific administrative management tool to implement investment projects, while clearly explaining the rationality and added value of including specialized technical planning in the national planning system, avoiding formality and overlap.
