For discotheque business, it is necessary to ensure conditions on fire prevention and fighting, security and order according to the provisions of Decree No. 96/2016/ND-CP and Decree No. 56/2023/ND-CP of the Government.
The People's Committee at the provincial level has the authority to grant, adjust and revoke the License for eligibility to conduct karaoke services or discotheque services.
Decree No. 148/2024/ND-CP also supplements the general responsibility of enterprises and business households when operating karaoke services and discotheque services to ensure compliance with the provisions of QCVN 06:2022/BXD National technical regulations on fire safety for houses and structures issued together with Circular No. 06/2022/TT-BXD dated November 30, 2022 of the Minister of Construction , Amendment 1:2023 QCVN 06:2022/BXD National technical regulations on fire safety for houses and structures issued together with Circular No. 09/2023/TT-BXD dated October 16, 2023 of the Minister of Construction, standards, technical regulations, regulations related to fire safety, load-bearing safety for houses and structures and fire prevention and fighting at karaoke service establishments and services. discotheque

Amending regulations on the authority to grant, adjust and revoke licenses for eligibility to operate karaoke services or discotheque services
Decree No. 148/2024/ND-CP amends and supplements the provisions on "Authority to grant, adjust and revoke Licenses of eligibility to conduct karaoke services or discotheque services" as follows:
The People's Committee at the provincial level has the authority to grant, adjust and revoke the License for eligibility to conduct karaoke services or discotheque services (called the Business Eligibility License).
The Department of Culture, Sports and Tourism or the Department of Culture and Sports receives and manages dossiers and business eligibility licenses under the licensing authority of the Provincial People's Committee.
Decentralization and authorization of procedures for granting, adjusting and revoking Business Eligibility Certificates according to regulations of law on local government organization.
Procedures for granting Business Eligibility Certificate
The Department of Culture, Sports and Tourism or the Department of Culture and Sports receives and manages dossiers and business eligibility licenses under the licensing authority of the Provincial People's Committee.
Decree amending and supplementing regulations on "Procedures for granting Business Eligibility Certificates" as follows:
Enterprises or business households shall send directly, by post or electronically 01 set of documents as prescribed to the dossier receiving agency.
In case the dossier is not in accordance with regulations, within 01 working day from the date of receiving the dossier, the dossier receiving agency shall issue a written notice requesting the dossier to be completed.
In case the dossier is complete as prescribed, within 03 working days from the date of receiving the dossier, the agency issuing the Business Eligibility Certificate shall appraise the dossier, establish an on-site appraisal team at the business location (hereinafter referred to as the appraisal team) on the business conditions prescribed in this Decree to advise the competent agency issuing the Business Eligibility Certificate to decide whether or not to issue the Business Eligibility Certificate. The appraisal team shall consist of no more than 07 members, including representatives of the following agencies: Public Security, Culture, Construction and other relevant agencies.
Within 04 working days from the date of establishment, the Appraisal Team shall organize the appraisal and issue the appraisal results according to Form No. 06 in the Appendix attached to this Decree.
Within 03 working days from the date of assessment results, the authority issuing the Business Eligibility Certificate shall be responsible for issuing the Business Eligibility Certificate according to Form No. 02 in the Appendix to this Decree or not issuing the Business Eligibility Certificate. In case of not issuing the Business Eligibility Certificate, a written response must be given stating the reasons.
The competent authority that issues the Business Eligibility Certificate shall send 01 copy of the Certificate to the enterprise or business household that is granted the Business Eligibility Certificate, the authority that issues the Business Registration Certificate or the business household, the district-level police agency where the business is conducted and keep 01 copy of the Certificate at the authority that issues the Business Eligibility Certificate, the agency that receives the application, and post it on the website of the authority that issues the Business Eligibility Certificate.
