That was the opinion, acceptance and explanation of Minister of Health Dao Hong Lan at the National Assembly's discussion session in the group on the Population Law on the morning of October 23.

Minister of Health Dao Hong Lan emphasized that the population issue is one of the important issues and has been mentioned in many documents of the Party and the State. Most recently, Resolution 72-NQ/TW dated September 9, 2025 of the Politburo also has many important orientations on population policy.
Minister Dao Hong Lan said that in recent times, population policies have been mainly implemented in accordance with the Population Ordinance. However, Vietnam is facing an aging population and a decreasing replacement fertility rate, requiring fundamental and urgent solutions. Therefore, the Government has assigned the Ministry of Health to urgently review, revise and supplement relevant regulations.
Minister Dao Hong Lan affirmed that when drafting the Population Law, the drafting agency selected issues that were not regulated by other laws to include in the Law, and reviewed them very carefully. Therefore, policies related to population structure and quality, reducing gender imbalance at birth, replacement fertility and population aging are the core contents of the policy.
Going into the specific content of the draft Law, Minister Dao Hong Lan said: Regarding the issue of surrogacy, the Minister believes that it should not be included in the draft Law on Population. This issue will be considered and calculated based on many socio-economic factors to make an appropriate decision when the National Assembly amends the Law on Marriage and Family.
Minister Dao Hong Lan said that surrogacy is regulated in the 2014 Law on Marriage and Family and has been effective since 2015. This is an issue that has been discussed very carefully by the National Assembly and debated fiercely by public opinion, because it is related to many aspects of society, especially family issues, legal issues, the rights of surrogate mothers, and the issue of social and psychological consequences...
Therefore, the issue of surrogacy is considered very carefully by the National Assembly, and Vietnam is also one of the few countries that have regulations on the right to surrogacy, while the majority of countries do not implement this issue. However, when analyzing the right to motherhood of infertile women, the determination that surrogacy for humanitarian purposes has also been included in the law.
Regarding the policies in the draft Law, Minister Dao Hong Lan said that the Ministry of Health really wants to have specific policies, especially monetary support policies. However, this needs to be balanced in many aspects, especially financial resources.
Regarding the social housing support policy for those who have two children, the draft Law proposes to add more priority groups. Currently, priority groups for purchasing or renting social housing include families of people with revolutionary contributions, relatives of martyrs, people with disabilities, and people who are resettled.
“We propose to add priority subjects to families where women give birth to two children, or men with two biological children whose wives have passed away. The goal is to help families with two children have more stable living conditions. The draft law approaches it from that perspective,” said Minister Dao Hong Lan.
