Many points to note about evaluating cadres, civil servants and public employees from September 15

Decree 48/2023/ND-CP amends and supplements a number of articles of Decree 90/2020/ND-CP on assessment and classification of the quality of cadres, civil servants and public employees, effective from September 15. The Decree has supplemented the assessment and classification of the quality of cadres, civil servants and public employees.

Currently, Article 2 of Decree 90/2020/ND-CP stipulates the principles for assessing and classifying the quality of cadres, civil servants and public employees.

Firstly, ensure objectivity, fairness, and accuracy; no favoritism, suppression, bias, or formality; ensure proper authority in managing and evaluating cadres, civil servants, and public employees.

Second, the assessment and classification of quality must be based on assigned responsibilities and tasks and the results of task performance, demonstrated through specific work and products; for leaders, civil servants, and public employees, it must be linked to the results of task performance of the agency, organization, or unit assigned to manage and be in charge.

Third, cadres, civil servants and public employees whose working time in the year is less than 6 months will not be assessed and classified for quality, but must still review their working time in the year, except in cases of maternity leave.

Cadres, civil servants and public employees who take leave from work according to the provisions of law during the year from 03 months to less than 6 months will still be evaluated but will not be classified as having completed their tasks well or better.

For cadres, civil servants and public employees who take maternity leave according to the provisions of law, the quality classification result in the year is the quality classification result of the actual working time of that year.

Fourth, the results of assessment and classification of the quality of cadres, civil servants and public employees according to the provisions of this Decree are used as a basis for interconnection in assessment and classification of the quality of Party members.

However, the Government issued Decree 48/2023/ND-CP amending Decree 90/2020/ND-CP on assessment and classification of the quality of cadres, civil servants and public employees.

Accordingly, Decree 48/2023/ND-CP supplements regulations on assessment and classification of quality for cadres, civil servants and public employees subject to party discipline or administrative discipline from September 15, 2023 as follows:

Cadres, civil servants and public employees who are subject to party or administrative disciplinary action in the assessment year shall be classified as not completing their tasks, except for the case specified in Point b of this Clause.

In case a violation has not been subject to a disciplinary decision by a competent authority but has been used as a basis for assessing and classifying the quality as not completing the task in the assessment year, the disciplinary decision issued after the assessment year for that violation (if any) shall not be counted for assessing and classifying the quality in the year of the disciplinary decision.

In case a cadre, civil servant or public employee is a party member and has been subject to party disciplinary action and administrative disciplinary action for the same violation, but the party disciplinary decision and the administrative disciplinary decision do not take effect in the same year of assessment, it will only be considered as a basis for quality classification in one year of assessment.

The proportion of cadres, civil servants and public employees classified as "Excellently completing tasks" among the total number of cadres, civil servants and public employees at the same agency, organization or unit and for each group of subjects with similar tasks must not exceed the proportion of Party members classified as "Excellently completing tasks" according to Party regulations.

In case an agency, organization or unit has outstanding achievements, completes assigned tasks ahead of schedule, completes unexpected tasks well, proposes or organizes innovation, creates positive changes, brings practical value and efficiency, then the competent authority shall decide on the rate of excellent task completion in accordance with reality, ensuring the rights and legitimate interests of cadres, civil servants and public employees.
