(NLDO)- Khanh Hoa Provincial People's Committee has decided to ban 4/5 companies from outside the province from participating in bidding for projects using state budget capital because of "fraudulent" behavior.
Accordingly, from September 2024, during the bidding process, Khanh Hoa provincial authorities discovered that 5 companies had falsified bidding documents for the construction and equipment package (package 5) of the Dien Khanh Citadel relic restoration and embellishment project.
On February 12, Khanh Hoa Provincial People's Committee issued a decision to ban 4 companies headquartered outside the province from participating in bidding activities.
Dishonest declaration of key personnel
Prohibition of participation in bidding activities for business investment projects and procurement estimates using budget capital invested by agencies and units under Khanh Hoa province.
The companies were banned from bidding for three years for "fraudulent" behavior according to Point a, Clause 4, Article 16 of the Bidding Law, including: Viet Quang Construction Joint Stock Company No. 1 (headquartered in Ho Chi Minh City), Duc Tin Construction Design Company Limited (headquartered in Phu Yen ), Cultural, Sports and Tourism Construction Joint Stock Company (headquartered in Hanoi) and BHT Tay Son Investment and Construction Joint Stock Company (headquartered in Hanoi).

Accordingly, the Cultural, Sports and Tourism Construction Joint Stock Company, part of the consortium "Contractor for Dien Khanh Citadel Construction", has dishonestly declared that the key person implementing the project, Mr. Phan Van Tue, is Mr. Phan Van Tue. He claimed to have a diploma from the Hanoi University of Construction, but the school confirmed that it did not issue the diploma as the file sent for verification.
Viet Quang Construction Joint Stock Company No. 1 (headquartered in Ho Chi Minh City) is part of the consortium "Construction of Dien Khanh Citadel Relic". This company has made dishonest declarations about the key personnel implementing the project, Mr. Nguyen Hoang Nam. The company declared that Mr. Nam had a degree from the University of Technology - Danang University, but this school affirmed that it did not grant him a university degree.
In the joint venture of contractors "Joint venture for construction of the project of Restoration and embellishment of Dien Khanh Citadel", the construction equipment is mainly owned by BHT Tay Son Investment and Construction Joint Stock Company. However, through verification, the above inspection certificate was not issued by INCOSAF Construction Consulting and Safety Technical Inspection Joint Stock Company.
Also in this consortium, Duc Tin Construction Design Company Limited (headquartered in Phu Yen) committed a similar violation when the key person implementing the project, Ms. Nguyen Thi Nguyet Cang, had a degree from the University of Mining and Geology. However, after verification, the school confirmed that it did not grant Ms. Cang a university degree.
Proposal for administrative sanctions
Of the 5 enterprises whose investor is the Khanh Hoa Provincial Development Project Management Board, 4 have been banned from bidding for 3 years.
The 5th enterprise is Construction and Investment Company Limited (headquartered in Khanh Hoa).
According to the report of the Khanh Hoa Provincial Development Project Management Board, Construction and Investment Company Limited has declared dishonestly the equipment used to implement the project, renting it from many other units.
This has been verified and confirmed by the Provincial Police's Criminal Techniques Department: "The inspection certificate provided by the contractor on the bidding network is not consistent with the certificate provided by the Industrial Inspection Center II. Thus, this case is considered as the contractor arbitrarily falsifying documents of another unit to participate in the bidding."
Currently, businesses headquartered in Khanh Hoa have not been banned from bidding for 3 years in this period.
Regarding the reason, in the handling meeting, Khanh Hoa Provincial People's Committee agreed with the report of the Department of Planning and Investment that there was not enough basis to conclude that the Company had committed fraud according to the law in participating in the bidding activities of package No. 5.
Dien Khanh Citadel
With the violations mentioned, on November 5, the Provincial Development Project Management Board decided to cancel the bidding notice for package No. 5. From November 7, the package was invited to bid online for the second time. On November 12, this board reported to the Provincial People's Committee to issue a decision to ban the above-mentioned companies from participating in local bidding activities for 3 years.
In addition, the Provincial Development Project Management Board also recommended that the Provincial People's Committee impose administrative sanctions on units committing the above violations.
The project to restore and embellish the Dien Khanh Citadel relic has a total investment of more than 166 billion VND, invested by the Provincial Development Project Management Board. The project scale has 12 items.
The project's objective is to preserve and promote the historical and cultural values of the national relic of Dien Khanh Citadel; contributing to serving the political tasks, economic, cultural and social development of the province in general and Dien Khanh district in particular.
