Government: Protecting personal data systems, preventing cyber attacks

(Dan Tri) - In developing the Law on Cyber ​​Security, the Government emphasized the need to closely combine the protection of personal data and prevention of cyber attacks with solutions to ensure national security in cyberspace.

This is one of the requirements made by the Government when issuing Resolution 283 on law-making in August, to give opinions on 8 draft laws and 1 draft law policy document.

The Government has commented on 8 projects including: Law on Judicial Expertise (amended); Law on Disease Prevention; Law on Population (amended); Law on Deposit Insurance (amended); Law on Saving and Anti-Waste; Law on Digital Transformation; Law on amending and supplementing a number of articles of the Law on Geology and Minerals; Law on Cyber ​​Security.

With the draft Law on Cyber ​​Security, the Government agrees on the necessity of developing a law to institutionalize the Party's guidelines and policies, the State's policies and laws on cyber security, and the management and protection of cyberspace.

According to the Government's request, this draft law must ensure the consistency and synchronization of the legal system, eliminate overlaps and conflicts between the two current laws, create a clear and transparent legal framework, and meet the requirements of managing and protecting cyberspace.

The Government also noted the need to improve the effectiveness of cyber security activities, closely combining measures to protect information systems, personal data, and prevent cyber attacks with solutions to ensure national security in cyberspace.

The drafting of this law, at the request of the Government, needs to facilitate organizations, businesses and individuals in complying with the law, minimizing administrative procedures, while protecting legitimate rights, promoting a safe digital environment, and developing a sustainable digital economy .

The Government proposed to improve the defense, monitoring, warning and response mechanisms to cyber security risks and incidents, protect important national information systems, and enhance the capacity to prevent and overcome the consequences of cyber attacks, which is also the content required by the Government.

The Ministry of Public Security was assigned to preside over and coordinate with relevant ministries and agencies to research and absorb as much as possible the opinions of Government members and the opinions of delegates at the meeting to complete the draft law.

The draft Law on Cyber ​​Security will be reported to the Prime Minister before being submitted to the National Assembly at the 10th session.

Regarding the draft Law on Thrift and Anti-Waste, the Government agreed to develop the draft law in the direction of enhancing proactiveness, voluntariness, and self-awareness in thrift and anti-waste work.

The Government also believes that there should be a mechanism to identify wasteful behavior and violations in the organization of waste prevention and control and to have sanctions to deal with these behaviors. In addition, according to the Government, it is necessary to ensure a complete and synchronous legal basis for monitoring, checking, inspecting, detecting and handling wasteful behavior.

The drafting of the Law on Thrift and Anti-Waste must fully institutionalize the groups of wasteful behaviors that the Central Steering Committee on Anti-Corruption, Wastefulness, and Negativity pointed out in Instruction No. 63 dated April 28.

At the same time, the Government requires ensuring a full legal basis for the right to provide information and report wasteful behavior, and having a mechanism to protect entities providing and reporting information.

In particular, according to the Government, the draft law must ensure full and synchronous regulations on solutions to build a culture of thrift and anti-waste in the whole society; making the practice of thrift and anti-waste "voluntary" like "daily food, drink, and clothing".

After completion, the Minister of Finance was assigned to authorize the Prime Minister to sign the Government's submission on the Draft Law on Thrift and Anti-Waste to be submitted to the National Assembly at the upcoming 10th session.
