Review and overcome shortcomings in decentralization and delegation of authority in the field of Industry and Trade.

The Ministry of Industry and Trade is reviewing all legal documents to immediately promulgate, amend, and supplement them to overcome conflicts and overlaps that are not suitable for the two-level local government model.

The Ministry of Industry and Trade has just issued Official Dispatch No. 7628/BCT-TCCB on the implementation of Conclusion No. 195-KL/TW of the Politburo and Secretariat on the situation and performance of the political system apparatus and two-level local government.

The official dispatch of the Ministry of Industry and Trade clearly stated that units, according to their assigned functions and tasks, must overcome existing shortcomings and limitations such as different understandings in the authority of the Provincial People's Committee in granting transit permits for goods on the list of goods.

Some other shortcomings were also pointed out such as: Need for guidance on understanding the authority of the Provincial People's Committee in granting certificates of origin of goods according to Decree No. 146/2025/ND-CP and Circular No. 40/2025/TT-BCT; Guidance on different understandings in the authority of Decree No. 146/2025/ND-CP stipulating that the Provincial People's Committee shall grant transit permits for goods on the list of goods prohibited from export and import; goods temporarily suspended from export and import; goods prohibited from trading.

In addition, there are no guidelines on decentralization and authorization in industrial cluster management in Decree No. 139/2025/ND-CP. Some tasks are assigned to the commune level but require appraisal and approval from the provincial level (industrial promotion projects, electricity retail licensing, industrial cluster planning, etc.), leading to waiting, shirking of responsibility or delay in processing documents; there are no specific coordination regulations, causing overlap and lack of consistency.

Some difficulties and problems with administrative procedures that localities encounter are: Some administrative procedures in the field of Industry and Trade stipulate a processing time of 5-20 days, but the process of processing records requires the coordination of many relevant agencies, leading to administrative procedure records in these fields being frequently delayed.

The leaders of the Ministry of Industry and Trade assigned the Legal Department to preside over and coordinate with units according to assigned functions and tasks such as reviewing all legal documents to issue, amend and supplement immediately, ensuring to overcome the situation of contradictions, overlaps, and inconsistencies with the 2-level local government model.

The Legal Department shall promptly study, amend, supplement, and promptly and fully promulgate working processes, reform, and simplify administrative procedures for tasks that have been decentralized, delegated, and assigned authority to the provincial and communal levels to ensure ease of implementation and inspection; organize training and equip knowledge and skills for civil servants at the provincial and communal levels to effectively perform decentralized and delegated tasks.

In addition, thoroughly review and evaluate the feasibility of implementing the tasks of decentralization, delegation of authority, and division of authority in management, propose solutions to promptly and thoroughly resolve problems; promptly amend and supplement and submit to the Government for promulgation decrees related to the operation of the 2-level local government model in the field of Industry and Trade; review and adjust decentralization and delegation of authority to the grassroots.

The Ministry's Office is assigned to preside over and coordinate with the Legal Department to review the report to the Minister to issue a Decision to promulgate amended and supplemented administrative procedures for administrative procedures with changes in a number of regulations. Currently, there are a number of administrative procedures whose authority has been adjusted from the Department of Industry and Trade to the decision-making authority of the Provincial People's Committee, but the Ministry of Industry and Trade has not yet announced the Decision to amend and supplement according to regulations to promptly resolve administrative procedures for people and businesses.

The Department of E-commerce and Digital Economy is assigned to preside over and continue to advise on the implementation of solutions to promote the application of information technology and digital transformation in the operations of agencies; to monitor and urge units to focus on implementing tasks according to Plan No. 02-KH/BCĐTW of the Central Steering Committee on science and technology development, innovation and digital transformation, promoting interconnected, synchronous, fast and effective digital transformation to meet the requirements of restructuring the apparatus of the political system.

The Department of Personnel Organization shall take the lead in coordinating with relevant units in the ministry to urgently complete the proposal for the arrangement of public service units, state-owned enterprises and the internal apparatus of enterprises under the management authority of ministries, ministerial-level agencies, government agencies and localities in accordance with the new situation; to be completed in October 2025.

The Ministry of Industry and Trade also requested the completion of payment of regimes and policies for cadres, civil servants, and employees who have decided to retire or quit before August 31, 2025 and have not been paid./.
