Proposed solutions for three-wheeled vehicles and tractors transporting agricultural products

The Ministry of Transport has just issued Official Dispatch No. 3134/BGTVT-VT to the National Assembly Delegation of Lam Dong province in response to the petition of voters sent after the 6th Session of the 15th National Assembly on researching and having appropriate measures to support means of transport serving agricultural production.

“Voters reflect that banning three-wheeled vehicles and agricultural vehicles from operating on the roads is to ensure traffic safety, but it also creates difficulties for farmers in rural areas who use these vehicles to transport agricultural materials for production and transport agricultural products harvested from fields, gardens, and plantations that other vehicles cannot access. We request that the Ministry pay attention to research and have appropriate measures to support people in transportation,” Lam Dong province voters suggested.

Regarding the above-mentioned voters' petition, the Ministry of Transport agrees on the need to facilitate people in rural areas to use agricultural and forestry motorbikes and tractors to transport agricultural materials for production and to transport agricultural products harvested from fields, gardens and plantations that other means of transport cannot access.

Directive No. 1405/CT-TTg dated September 30, 2008 of the Prime Minister on continuing to manage agricultural vehicles, three-wheeled motor vehicles, three-wheeled and four-wheeled rudimentary vehicles according to the provisions of Resolution No. 32/2007/NQ-CP dated June 29, 2007 and Resolution No. 05/2008/NQ-CP dated February 4, 2008 of the Government, in which Point d, Clause 1 of the Directive stipulates:

“1. People's Committees of provinces and centrally-run cities urgently carry out the following tasks:

... d) For small tractors serving agricultural and forestry production with multi-purpose functions such as tilling land, pumping water, generating electricity, and transporting:

- Direct local authorities to conduct technical safety inspections, register and issue license plates for vehicles; train, test and issue driving licenses to drivers according to current regulations;

- Based on actual local conditions, specify the scope and operating time for this type of vehicle.”.

Thus, the use of the above vehicles for transportation to serve agricultural production will be regulated by the locality on the basis of ensuring compliance with current regulations and in accordance with the actual conditions of each locality, ensuring traffic safety and convenience for production activities, while meeting the process of agricultural and rural development, liberating farmers' labor.

Currently, the Ministry of Public Security and the Ministry of Transport are completing two drafts of the Law on Traffic Order and Safety and the Road Law under the direction of the Government to submit to the National Assembly Standing Committee to report to the National Assembly in May 2024.

In particular, the draft Law on Traffic Order and Safety has provisions adjusting the types of vehicles proposed and recommended by voters of Lam Dong province.
