What is a homemade car?
According to the provisions of Resolution 32/2007/NQ-CP guided by Directive 1405/CT-TTg and Official Dispatch 4642/BGTVT-VT), homemade vehicles are understood to be vehicles that do not meet technical safety standards and are manufactured and installed in violation of traffic regulations, including:
- Farm vehicles (also known as cross-head vehicles, modified vehicles, dump trucks...) are vehicles assembled from single-cylinder diesel engines and utilizing automobile components.
- Small tractors serving agricultural and forestry production often have multi-purpose features such as: tilling land, pumping water, generating electricity, transporting...
- 3-wheeled and 4-wheeled primitive vehicles, except 3-wheeled vehicles used as vehicles for war invalids and homemade vehicles for the disabled, with registration and license plates.

What is the penalty for using a homemade vehicle?
According to Clause 4, Article 8 of the 2008 Road Traffic Law, driving motor vehicles and specialized motorbikes that do not meet technical safety standards is a prohibited act in road traffic.
Accordingly, in Articles 16, 17 and 18 of Decree 100/2019/ND-CP amended by Decree 123/2021/ND-CP, the fine for using homemade vehicles in violation of traffic regulations is as follows:
For motorcyclists, fines from VND 2,000,000 to VND 3,000,000 for one of the following violations:
+ Driving a temporarily registered vehicle beyond the permitted range and time limit.
+ Driving vehicles manufactured or assembled in violation of traffic regulations.
In addition, motorcyclists who violate the above regulations will also face additional penalties such as vehicle confiscation and driver's license revocation for 1 to 3 months.
For car drivers, a fine of 10,000,000 VND to 12,000,000 VND shall be imposed on car drivers (including agricultural vehicles subject to suspension from traffic with trailers or semi-trailers being towed, trailers and semi-trailers being towed).
In addition, the driver of a car violating the above acts shall also be subject to additional penalties such as confiscation of the vehicle (except for cars with 10 seats or more used for passenger transport business with a usage period exceeding the business conditions of the registered business form but not more than 20 years from the year of manufacture, cars with less than 10 seats used for passenger transport business). The driver's license shall be revoked for a period of 1 to 3 months.

For tractor and specialized vehicle drivers, a fine of VND 1,000,000 to VND 2,000,000 shall be imposed for one of the following violations:
+ Driving the vehicle outside the prescribed range.
+ Driving tractors, specialized motorbikes that are manufactured, assembled or modified in violation of traffic regulations.
In addition, drivers of tractors and specialized vehicles who violate the above acts will also be subject to additional penalties such as having their driving license revoked (when driving tractors) or certificates of training in road traffic law (when driving specialized vehicles) from 1 to 3 months.
Criminal prosecution if causing an accident.
+ May be fined 20,000,000 - 100,000,000 million VND or imprisoned from 6 months to 10 years depending on the level and consequences.
+ Banned from holding positions and practicing a profession from 1 to 5 years.
+ Compensation for personal and property damage.
