Amending regulations on procedures for exporting and importing ships

A notable point in the draft is the proposed amendment related to procedures for exporting and importing ships.

According to current regulations, procedures for exporting and importing ships are based on decisions on purchasing, selling, and building new ships; contracts for purchasing, selling, and building new ships; ship delivery and receipt records, and documents confirming the technical status of ships from the Vietnam Register. Customs authorities are responsible for carrying out procedures for exporting and importing ships.

According to regulations, after completing the first inspection and the ship satisfies the regulations of Vietnam and relevant international treaties, the inspection unit must issue inspection documents (including technical safety and environmental protection certificates) for the ship to operate (Illustration photo).

However, the draft Decree proposes to remove the ship handover record and the document confirming the technical status of the ship from the Vietnam Register after conducting the first inspection of imported ships.

The reason is that, according to Circular 17/2023 amending and supplementing a number of articles of Circular 40/2016 regulating the inspection of Vietnamese seagoing vessels, inspection units have been assigned to conduct inspections and issue inspection documents for seagoing vessels.

After completing the first inspection and the vessel satisfies the regulations of Vietnam and relevant international treaties, the inspection unit must issue inspection documents (including technical safety and environmental protection certificates) for the vessel to operate.

According to the Ministry of Transport , the Vietnam Register has developed a project to "Reorganize advisory and support organizations and units under the Vietnam Register" to implement the direction of the Prime Minister and the Ministry of Transport to separate the state management function and the function of providing public services. The project has been submitted to the Ministry of Transport for consideration and approval.

"Therefore, the regulation requiring a document confirming the technical status of the Vietnam Register is no longer appropriate and unnecessary," the Ministry of Transport commented.

In addition to the above procedures, the draft Decree also stipulates that physical inspection of exported vessels is carried out at the Vietnamese seaport where the vessel completes exit procedures to foreign countries for handover. For imported vessels, physical inspection is carried out at the first seaport when the vessel arrives in Vietnam to complete entry procedures.

In case export procedures are required for a ship that has left the country, the customs authority shall carry out export procedures without having to bring the ship back to Vietnam, provided that the ship owner has a written commitment and is responsible before the Law that his ship has completed all exit procedures as prescribed.
