On the morning of October 22, continuing the 10th Session, National Assembly delegates discussed in groups the Law on Civil Servants (amended).

Link flexible recruitment with the principles of transparency and publicity

Discussing in the group, delegate Le Thi Thanh Lam (Can Tho Delegation) agreed with the conversion of the method of managing civil servants according to job positions as stipulated in the draft Law to suit the current trend of public sector reform, in order to meet the requirements of strong innovation in methods of recruitment, assessment, planning, training, fostering, arrangement and use of cadres, civil servants and public employees in the political system. Thereby, contributing to creating a legal basis for implementing salary payment according to job positions in the spirit of Resolution No. 27-NQ/TW dated May 21, 2018; ensuring consistency and consistency with the method of managing cadres and civil servants stipulated in the Law on Cadres and Civil Servants.

Regarding the method of recruiting civil servants, delegate Thanh Lam said that paving the way for direct recruitment of talented experts and civil servants without traditional examinations is a necessary step to accelerate talent attraction. However, according to the delegate, if there is a lack of clear regulations on selection criteria, transparency of records, and independent inspection, it is easy to lead to the risk of "tailoring" positions, bias and sentiment in public recruitment - reducing public trust and the quality of State human resources. Therefore, the delegate suggested that flexible recruitment should be linked to the principles of transparency, publicity, clear post-inspection regulations and the responsibilities of unit heads must be clearly defined.

Delegate Doan Thi Le An (Cao Bang Delegation) proposed to expand and be more flexible in recruitment methods, not only through exams but also combining capacity assessment, interviews or selection based on actual capacity.

“It is recommended to supplement or clarify the special recruitment mechanism for disadvantaged areas. Allow direct recruitment (without examination) for good doctors and pharmacists who volunteer to work in particularly disadvantaged areas, or loosen recruitment standards, for example, accepting recruitment of graduates according to the address of use,” said the delegate.

Regarding the basis for recruiting civil servants, delegate Le Thi Thanh Lam proposed to add transparent rules for direct recruitment. Accordingly, it is necessary to clearly stipulate the list of positions to be recruited, application criteria, candidate profiles, and assessment results. At the same time, establish an independent post-audit mechanism (for example, through the Government Inspectorate or a specialized inspection agency) to ensure a transparent and responsible selection process and monitor good quality results.

Build a clear conflict of interest control mechanism

Delegate Nguyen Thi Viet Nga, Deputy Head of the National Assembly Delegation of Hai Phong city, expressed her high approval of the addition of regulations on the rights of civil servants in professional activities and business activities as stated in Article 13 of the Draft Law on Civil Servants (amended).

According to the delegate, this is a very remarkable new point, demonstrating a strong spirit of innovation in the management and use of civil servants, in line with the Party's policies and the requirements of socio-economic development in the new context. It demonstrates modern management thinking, shifting from "management by prohibition" to "management by open legal framework", encouraging creativity, autonomy and professional responsibility.

However, delegates noted that it is necessary to clearly define the scope of allowed and not allowed participation in business activities of civil servants. For example, civil servants in the fields of education, health, science and technology can participate in scientific enterprises and technology transfer; but should not arbitrarily expand to fields unrelated to their expertise.

At the same time, a clear mechanism for controlling conflicts of interest should be established to avoid cases where officials take advantage of their positions, internal information, or state resources for personal gain while participating in businesses.

According to the Viet Nga delegate, there should be guidance on responsibilities, obligations and income regimes when civil servants join enterprises or sign contracts outside the unit. It must be ensured that civil servants still fully complete their tasks at the agency, without affecting the quality of public service.

On the other hand, focus on training and coaching staff on business law, corporate governance, intellectual property, etc. so that they have the capacity to participate in this field effectively, transparently, and legally.

“If guided, implemented synchronously and with a reasonable control mechanism, this will be a strong driving force to unleash the potential of civil servants, turning intelligence and research results in the public sector into national development resources,” the delegate expressed.

Commenting that this is a necessary new regulation, delegate Ha Sy Dong (Quang Tri Delegation) also warned that "conflicts of interest can easily arise".

Delegates proposed clearly defining the mechanism for declaration, approval and list of prohibited locations; at the same time, defining the responsibility of leaders in controlling and handling violations.

“It is necessary to clearly define the criteria, procedures and approval authority for civil servants' extracurricular activities; and have a list of absolutely prohibited positions to prevent conflicts of interest,” the delegate recommended.
