
In the context of digital transformation spreading widely in all fields, the draft Law on Digital Transformation is considered an important step to institutionalize the policy of developing the digital economy and digital society. The draft sets out many new regulations on data management, electronic identification, digital platforms and responsibilities of entities in the network environment.
However, the implementation in localities, especially Ho Chi Minh City, shows that there is still much content that needs to be completed to ensure consistency and feasibility, especially in the context of increasing fraud, spreading false information and appropriation of personal data in cyberspace.
According to Head of the Propaganda and Mass Mobilization Department of the Ho Chi Minh City Party Committee Duong Anh Duc, the draft Law on Digital Transformation needs to more clearly define prohibited acts and increase deterrence in enforcement. Simply stating "violations of the law" in general is not enough to deal with the forms of exploiting artificial intelligence, deepfake or digital platforms to spread false information and manipulate personal data. When acts are specifically identified, authorities have a clear legal basis to handle and protect people more effectively, thereby strengthening trust in digital transformation.
The Head of the Propaganda and Mass Mobilization Department of the City Party Committee also noted the overlap between the Law on Information Technology and the Law on High Technology, especially the regulations related to software technology parks and concentrated information technology parks. The lack of consistency makes it difficult to apply policies, so it is necessary to review to ensure synchronization of laws on technology and digital transformation.
Regarding preferential policies, the Head of the Propaganda and Mass Mobilization Department of the City Party Committee said that it is impossible for businesses in the same field, contributing to the digital economy, to enjoy different incentives just because of different investment locations. Policies need to be designed on the principle of fairness to encourage innovation and equal development in the digital business ecosystem.
The Law on High Technology (amended) needs to clearly stipulate that zones in the fields of software technology, information technology and similar fields can apply similar incentives. Expanding the beneficiaries will create a healthy competitive environment, support businesses to develop sustainably and promote the national digital transformation process.

Director of the Ho Chi Minh City Digital Transformation Center Vo Thi Trung Trinh said that people's digital trust is the core factor to ensure success. Trust is only strengthened when personal data, transaction information and privacy are absolutely protected. Therefore, the draft Law on Digital Transformation needs to be placed in close connection with the Law on Data, the Law on Information Security and the Law on Cyber Security to form a unified legal entity, helping administrative, civil and commercial transactions in the digital environment take place safely and transparently.
The Director of the City Digital Transformation Center emphasized that the essence of digital transformation is data. If the law does not clarify the content of data and the governance mechanism, but only stops at administrative regulations, it will be difficult to form a real data economy. The national data architecture framework needs to be linked to a complete, standardized data system and an effective sharing and exploitation mechanism between state agencies, organizations and businesses.
According to the Head of the City National Assembly Delegation, the National Assembly's consultation on the draft Law on Digital Transformation and related laws is of particular importance in the context of the whole country implementing Resolution 57 of the Politburo on science, technology development, innovation and national digital transformation. Gathering opinions from experts, scientists and the business community will help perfect the legal framework, ensuring feasibility so that when promulgated, the laws will actually come into life.
Successful digital transformation depends not only on infrastructure and technology but also on a strong enough legal corridor to protect people, build social trust and build a safe and reliable digital space for long-term development.
