The Circular applies to people with positions and powers after leaving their positions in state agencies, organizations and units under the management of the Ministry of Information and Communications and other relevant agencies, organizations and individuals.

The fields under the management of the Ministry of Information and Communications in which people with positions and powers in that field, after leaving their positions, are not allowed to establish, hold titles, management positions, or operate enterprises and cooperatives, including:

1. Press.

2. Publishing, printing and distribution.

3. Radio and television.

4. Electronic information.

5. Foreign information.

6. Basic information.

7. Postal services.

8. Telecommunications.

9. Radio frequency

10. Information technology industry.

11. Application of information technology, digital transformation.

12. Network information security.

13. Electronic transactions.

14. Management of state-owned enterprises with the Ministry of Information and Communications as the owner representative.

15. Programs, plans and projects in the fields and tasks specified in Clauses 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13, 14 of this Article shall be directly researched, developed or appraised and approved by the person who ceases to hold the position or authority while being an official, civil servant or public employee.

After leaving office, a person holding a position or authority in a field under the management of the Ministry of Information and Communications is not allowed to establish, hold a title or management position, or operate an enterprise or cooperative in the field he or she was previously responsible for managing.

The Circular clearly states that for those who do not hold leadership or management positions, the period of time for not being allowed to establish, hold management or executive titles or positions in enterprises or cooperatives in the fields they were previously responsible for managing in the list specified in Clauses 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13, 14, Article 4 of this Circular is 12 months from the date of termination of authority according to the decision of the competent authority.

For those holding leadership and management positions, the period of time in which they are not allowed to establish, hold management or executive titles or positions in enterprises and cooperatives in the fields they were previously responsible for managing in the list specified in Clauses 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13, 14, Article 4 of this Circular is 24 months from the date of ceasing to hold the position according to the decision of the competent authority.

This Circular takes effect from the date of signing./.
