Are union officials who resign entitled to benefits and policies according to Decree 178?

Employees who are union officials working under contract and receiving salaries from union financial resources will receive severance pay according to Resolution No. 07 of the Government.

Ms. Tran Thi Hang Ng. is a contract employee, starting to work as an accountant at the District Labor Federation from August 1, 2005. In 2007, she signed an indefinite-term labor contract, was classified as a civil servant and had her salary increased regularly according to regulations.

The unit where Ms. Ng. worked ceased operations as of June 30 this year. Ms. Ng. wondered whether she was eligible for benefits under Decree No. 178/2024 and Decree No. 67/2025 of the Government .

Regarding this issue, the Ministry of Home Affairs said that on September 17, the Government issued Resolution No. 07 regulating policies and regimes for subjects affected by the process of reorganizing the apparatus and administrative units at all levels. This Resolution was issued based on Conclusion No. 183 dated August 1 of the Politburo and the Secretariat.

According to the provisions of the Resolution, the subjects of application include union officials working under labor contracts and receiving salaries from union financial resources. This is the group of workers directly affected when organizing, merging, and dissolving units in the union system and State administration.

In the case of Ms. Ng., a long-term contract employee working at the district-level labor federation (a unit that has ceased operations) and has a continuous working history, her consideration for support benefits is completely justified according to current regulations.

The Ministry of Home Affairs recommends that you contact the local competent authority, specifically the Provincial and Municipal Labor Federations and the Department of Home Affairs, for guidance on procedures and to resolve the regime in accordance with regulations.

Ensuring the rights of workers during the organizational restructuring process is one of the important contents prioritized by the Government, in order to ensure stable life and social security for cadres, civil servants, public employees and workers in the political system.

Payment due by November 1st at the latest

According to the representative of the Vietnam General Confederation of Labor, Resolution No. 07 clearly stipulates: Only those who signed labor contracts before January 15, 2019 are eligible for support benefits.

Statistics from the provincial and municipal labor federations show that there are 511 cases eligible for this benefit. However, according to regulations, only 425 cases are eligible for this benefit. The total amount expected to be paid is more than 400 billion VND from the union's financial resources.

Depending on the working time, position and insurance contribution level, the amount of money paid to employees who resign according to Resolution 07 can range from 700 million VND to more than 2.2 billion VND/person. This is a carefully calculated number, in accordance with the principle of ensuring the rights of employees.

In addition, according to incomplete statistics from provincial and municipal trade unions, as of June, 399 trade union officials had received policy support under Decree 178/2024. Among the officials managed by the Vietnam General Confederation of Labor who retired under this Decree, 88 cases had been resolved.

Mr. Nguyen Xuan Hung - Vice President of the Vietnam General Confederation of Labor said that due to the deadline for payment of benefits to the subjects being November 1st at the latest, the General Confederation has requested the local labor federation to complete procedures, review documents, and issue decisions to terminate contracts in accordance with regulations to ensure the rights of workers.
