New regulations on participation in Unemployment Insurance

The revised Law on Employment 2025 has many new regulations on Unemployment Insurance (UI) policy.

Specifically, Clause 1, Article 31 adds 3 new groups of subjects participating in social insurance, including:

Employees working under a labor contract with a term of one month or more, including cases where the employee and employer agree on a different name, but the content includes paid work, salary and management, operation and supervision by one party;

Employees specified in Point a of this Clause who work part-time and have a monthly salary equal to or higher than the lowest salary used as the basis for compulsory social insurance contributions as prescribed by the Law on Social Insurance;

Business managers, controllers, representatives of the capital of enterprises as prescribed by law; members of the Board of Directors, General Directors, Directors, members of the Supervisory Board or controllers and other elected management positions of cooperatives and cooperative unions as prescribed by the Law on Cooperatives receiving salaries. (In which employees who are business managers, cooperative managers receiving salaries and participating in compulsory social insurance as prescribed by the law on social insurance are not prescribed in the 2013 Law on Employment but have been prescribed in Decree No. 28/2015/ND-CP dated March 12, 2015 of the Government detailing the implementation of a number of articles of the Law on Employment on unemployment insurance).

In addition, Clause 2, Article 31 also adds subjects that do not have to participate in unemployment insurance other than those receiving pensions or doing domestic work according to the 2013 Law on Employment, including: People receiving social insurance benefits, monthly allowances according to Government regulations or eligible for pensions; employees working under probationary contracts according to labor law regulations.

The 2025 Law on Employment also assigns the National Assembly Standing Committee to decide on unemployment insurance participation for other subjects who have stable and regular jobs and incomes based on the Government's proposal in accordance with the economic and social development conditions of each period. This provision creates conditions for expanding unemployment insurance participation to other groups of subjects in accordance with changes in labor relations, economic and social development conditions, and the lives of workers in the future.
