Sending comments to the conference on the Draft Law on Road Traffic Order and Safety, the Hanoi Department of Justice basically agrees with the content of the Draft Law. However, to make the Draft Law more complete, the Department of Justice proposed that the drafting committee study and add traffic participants using self-balancing electric 2-wheelers, scooters (with or without electricity), and movable electric suitcases. The reason is that these subjects are mainly children and minors. Participating in traffic by these means of transport has the potential to cause traffic insecurity and traffic accidents, but the Draft Law has not yet classified or adjusted this subject.

Sharing this concern, Ms. Le Thanh Hieu, Head of the Advisory, Criticism and Social Appraisal Board - Hanoi Union of Science and Technology Associations, said that Article 34 of the Draft Law currently does not mention some types of vehicles that children and minors are using to participate in traffic such as self-balancing 2-wheel electric vehicles, scooters, self-propelled electric suitcases, etc. These types of vehicles pose a potential risk to traffic safety, so it is recommended to supplement the classification and adjustment for these subjects.

Regarding some specific contents, Clause 2, Article 21 of the Draft Law on the use of horn signals stipulates that ".... horns shall not be used from 10:00 p.m. the previous day to 5:00 a.m. the following day in densely populated areas and medical examination and treatment facilities....", the Department of Justice requested the drafting committee to re-examine this provision because current reality shows that the number of vehicles circulating during this period is not small. Meanwhile, the lighting system during this period is also reduced to save electricity. In conditions where traffic light is not sufficient, traffic collisions/conflicts are likely to occur, causing traffic insecurity. If you want to warn other vehicles participating in traffic, traffic participants who are not allowed to use horns will not know what measures to use. Regulations such as those in the Draft Law can cause traffic insecurity for traffic participants and easily cause drivers to violate the law.

The Department of Justice also requested the drafting committee to re-examine the health examination for car drivers. Clause 2, Article 58 of the Draft Law stipulates that the Minister of Health is assigned to conduct periodic health examinations for car drivers.

According to the Department of Justice, health examinations for car drivers are necessary because drivers must be in good health to be able to operate vehicles when participating in traffic. However, it is necessary to limit the target group, to avoid wasting time and money of drivers, and should focus on the following groups: Drivers who are elderly (60 years old or older), truck drivers, drivers with a history of underlying diseases, drug addiction or other stimulants.

Review regulations to avoid motorbikes entering the highway

Regarding the Draft Road Law, the Hanoi Department of Justice basically agrees with the content and structure of the Draft Law. Commenting on some specific contents, the Department of Justice said that the regulation on traffic signs with changing information (VMS signs) is used when the information displayed on the sign needs to change depending on the traffic situation. Depending on the purpose, the information on the sign can be instructions, prohibitions, commands or danger and warnings. Signs cannot be used for advertising, use animated images, flashing images, or moving images.

Chapter III of the Draft Law on Expressways stipulates the content of investment in urban expressways. For this content, the Department of Justice recommends that the drafting committee needs to review to ensure that investment and construction of expressways in urban areas must ensure safety and be consistent with the system of signs; avoid the situation of motorbikes going into the wrong lane of the expressway due to unclear signs. This situation is quite common in the area of ​​Thang Long Avenue - Hanoi Capital.
