Perfecting the legal system on national digital transformation

Continuing the 50th Session, on October 16, under the direction of Vice Chairman of the National Assembly Le Minh Hoan, the National Assembly Standing Committee gave opinions on the draft Law on Digital Transformation.

Regarding the necessity of the Digital Transformation Law project, Deputy Minister of Science and Technology Vu Hai Quan said that the development of the Digital Transformation Law is necessary to achieve the main goals such as: Perfecting the legal system on national digital transformation, creating an inter-sectoral legal system on digital transformation in industries and fields; regulating the relationship between entities participating in activities in the digital environment; promoting the comprehensive digital transformation process; enhancing international cooperation and integration.

Overview of the meeting

The viewpoint of building the Law on Digital Transformation is to institutionalize the guidelines and policies of the Party and State (especially Resolution No. 57-NQ/TW dated December 22, 2024), in accordance with the Constitution, creating consistency in the Vietnamese legal system and international treaties to which Vietnam is a member.

The Law on Digital Transformation is a framework law, inheriting and developing the provisions of current laws that are still suitable for information technology, connecting current laws, and at the same time filling the legal gap on digital transformation to form a synchronous and comprehensive legal corridor to regulate and promote the national digital transformation process.

Do not re-regulate the content that has been regulated by other laws, do not change the State management responsibilities of ministries and branches. Selectively refer to the laws and practical experiences on the development trends of digital transformation of a number of countries in accordance with the practical conditions of Vietnam, the laws and international treaties to which Vietnam is a member.

The Law on Digital Transformation consists of 8 chapters and 79 articles regulating digital transformation, including: Infrastructure for digital transformation; Digital government and digital transformation of activities of agencies in the political system; digital economy; digital society and measures to ensure digital transformation. This law applies to Vietnamese agencies, organizations and individuals, foreign organizations and individuals directly participating in or having activities related to digital transformation in Vietnam. On August 21, 2025, the Standing Committee of the National Assembly issued Resolution No. 96/2025/NQ-UBTVQH15 on adjusting the 2025 Legislative Program, which was added to the 2025 Legislative Program to be submitted to the National Assembly for comments and approval at the 10th Session (October 2025) according to the shortened order and procedures for the draft Law on Digital Transformation.

On behalf of the review agency, Deputy Chairman of the Committee for Science, Technology and Environment Nguyen Phuong Tuan said that the Committee agreed with the necessity of promulgating the Law on Digital Transformation with the proposals in Submission No. 804/TTr-CP dated September 17, 2025 of the Government; the dossier of the draft Law on Digital Transformation submitted by the Government according to the simplified order and procedures is eligible to be submitted to the National Assembly Standing Committee for consideration before submitting to the National Assembly at the 10th Session.

The content of the draft Basic Law is consistent with the Party's policies, ensures constitutionality, legality, consistency with the legal system, compatibility with relevant international treaties, and ensures feasibility.

However, the Committee on Science, Technology and Environment requested the drafting agency to continue reviewing and comparing the draft Law with relevant laws in areas such as investment, bidding, state budget, etc.; at the same time, closely coordinate with the drafting agencies of the draft Laws being submitted to the National Assembly for consideration and approval at the 10th Session of the 15th National Assembly (Law on E-commerce, Law on High Technology (amended), Law on amending and supplementing a number of articles of the Law on Intellectual Property, Law on Cyber ​​Security, etc.) to ensure consistency in the legal system.

Within the framework of the meeting, members of the National Assembly Standing Committee affirmed the necessity of the Law on Digital Transformation in the process of socio-economic development as well as in many activities and services of life; at the same time, they said that the provisions of the Law on Digital Transformation need to be consistent and consistent with specialized laws and related laws.

Presenting his views at the meeting, Chairman of the Law and Justice Committee Hoang Thanh Tung suggested continuing to research and review to clearly determine the position of the Law on Digital Transformation in the legal system; paying attention to distinguishing the subjects of regulation of the draft Law from specialized laws and laws regulating the fields of science, technology and innovation that have just been passed by the National Assembly to clarify the scope of regulation and avoid overlaps and duplications.

Contributing opinions to the draft Law on Digital Transformation, Vice Chairwoman of the National Assembly Nguyen Thi Thanh said that the draft Law has demonstrated the spirit of inheriting the reasonable contents of the Law on Information Technology; at the same time, adding new regulations in line with modern technology trends such as: artificial intelligence, big data, internet of things, blockchain and digital copies.

In addition, the drafting agency also consulted the digital government framework along with international laws of the European Union, Japan, Korea, etc. Thereby helping the draft Law approach advanced standards, creating a legal foundation, promoting comprehensive digital transformation with the spirit of taking people and businesses as the center, towards a sustainable digital economy and digital society.

Agreeing with the above viewpoint and contributing opinions to the draft Law on Digital Transformation, Vice Chairman of the National Assembly Nguyen Khac Dinh requested the Government and ministries to uphold their sense of responsibility so that when this law is issued and takes effect, the digital transformation process must be accelerated and the characteristics of digital transformation must be stated.

Expressing his views on digital infrastructure, Vice Chairman of the National Assembly Nguyen Khac Dinh also suggested that the Government conduct research to unify digital infrastructure in localities; avoid the situation where each province invests in a center, each province invests in a type of machinery, each province hires a company to write a different language, which affects connectivity. In addition, when the Law on Digital Transformation is issued, it must also reduce costs, limit the situation where every province invests in a center, every province has to add staff, every province proposes to buy machinery... In addition, the Vice Chairman of the National Assembly also suggested that the Government conduct research to ensure system connectivity when implementing digital transformation.

On behalf of the agency drafting the Law on Digital Transformation, Minister of Science and Technology Nguyen Manh Hung affirmed the importance of the law in helping to resolve difficulties in current digital transformation activities as well as promoting socio-economic development.

Regarding the opinions and proposals of the members of the National Assembly Standing Committee, Minister of Science and Technology Nguyen Manh Hung said that the Ministry will fully absorb the comments during the process of completing the draft Law to send to the review agency before submitting it to the National Assembly for consideration and comments at the upcoming 10th Session.

Concluding the session, Vice Chairman of the National Assembly Le Minh Hoan affirmed that the National Assembly Standing Committee highly appreciated the Government and the drafting agency for their serious and proactive preparation of the draft law documents, ensuring completeness and progress according to regulations. The review report of the Committee on Science, Technology and Environment comprehensively mentioned, deeply analyzed and had opinions on a number of specific issues to continue perfecting the draft law.

To continue perfecting the draft law submitted to the National Assembly, the National Assembly Standing Committee requested the Government to direct research, supplement, clarify and note a number of contents: Continue to deeply understand and review, fully institutionalize the policies, guidelines, resolutions, and conclusions of the Party Central Committee and the Politburo to remove bottlenecks, promote development, and create breakthroughs in digital transformation. Strictly implement Regulation 178 of the Politburo on controlling power and fighting corruption and negativity in law-making work.

The National Assembly Standing Committee requested the Government to carefully review the regulations related to digital transformation in the system of legal documents. In addition, it requested the Government not to re-regulate or refer to regulations in previous legal documents to avoid conflicts, overlaps or increase the cost of legal compliance during implementation, clearly defining the scope of the digital economy regulated in the draft Law with economic fields regulated in other laws that use digital technology and digital platforms to ensure unified management regulations. Focus clearly on the specific responsibilities of the parties in digital transformation activities. Complete regulations on removing financial and procurement obstacles for digital transformation.

The Government also needs to study and supplement regulations on specific procurement mechanisms for high-tech products and services that are complex, exclusive and of national strategic nature. Supplement regulations allowing the application of flexible payment methods including partial or full prepayment for technology rental services to suit market practices. Complete regulations on State management of digital transformation to ensure comprehensiveness, multi-sectoral, and avoid overlaps and duplication of functions and powers between relevant ministries and sectors in digital transformation.

The National Assembly Standing Committee also requested the Government to direct the drafting agency and relevant agencies to study and absorb the opinions of the National Assembly Standing Committee and the review opinions to complete the draft Law dossier to be submitted to the National Assembly. The Committee on Science, Technology and Environment was assigned to complete the review report to be submitted to the National Assembly for consideration at the 10th Session as prescribed. The Head of the National Assembly Office announced the conclusions of the National Assembly Standing Committee for agencies, organizations and individuals to know and implement.
