Mr. Cuong said, the biggest difference in legal consequences between a person who has more than half to two-thirds of the total number of delegates giving a low confidence rating and a person who has more than two-thirds of the total number of delegates giving a low confidence rating is whether or not there must be an additional round of confidence voting.

In addition, according to the draft regulation, for people with low confidence votes, the agency or person that recommends that person for the National Assembly or People's Council to elect or approve is responsible for submitting to the National Assembly or People's Council for a confidence vote at that session or the nearest session.

According to Mr. Cuong, this regulation has two shortcomings that need to be considered. In particular, the authority to submit to the National Assembly and People's Council for a vote of confidence contradicts the regulation assigning the National Assembly Standing Committee and People's Council Standing Committee to submit.

In addition, the timing of the vote of confidence is currently regulated in an arbitrary manner, that is, at that session or the nearest session. As this regulation states, the timing of the vote of confidence can be 4-5 months apart. This does not create unity or equality among those with low confidence votes from 50% to 2/3. Therefore, he proposed to regulate only one time for voting at that session.

If we add up the two votes of confidence and the vote of no confidence, it will take about 8-10 months for us to dismiss him. "Doing so can lead to very harmful consequences for state management as well as public opinion when this information is made public in the media," Mr. Cuong added.

Delegate Mai Thi Phuong Hoa ( Nam Dinh delegation) proposed to add a regulation that the head and collective leadership of the agency or unit must take responsibility in case of abuse of the vote of confidence and vote of no confidence, causing internal disunity. At the same time, in organizing the implementation, it is necessary to do a good job of grasping the situation and ideological work to prevent this from early and far away.

Delegate Nguyen Thi Viet Nga (Hai Duong delegation) suggested adding criteria for the exemplary behavior of the person himself/herself and his/her spouse and children in complying with the State's laws and policies.

Ms. Nga said that it is necessary to consider, review and possibly clarify the group of subjects who have close family relationships with the person who is being voted on or has a vote of confidence. In addition, it is necessary to clarify the criteria of the exemplary behavior of the wife, husband, and children in complying with legal policies, as a basis for assessment related to the assigned tasks and powers of the person who is being voted on or has a vote of confidence.

This is to avoid taking advantage of personal violations of relatives to reduce their prestige in holding assigned positions.

Explaining later, Head of the Delegation Affairs Committee Nguyen Thi Thanh stated that the vote of confidence is conducted once in the third year of the term. For this term, the National Assembly will conduct a vote of confidence at the 6th session in October. Ms. Thanh stated that, comparing with Regulation No. 96, summarizing practice, the regulation on the timing of the vote of confidence is reasonable.
