
The Ministry of Science and Technology issued new regulations on conditions and procedures for switching mobile networks.
The Circular is issued to specify Clause 9, Article 12 of Decree No. 163/2024/ND-CP of the Government , detailing and guiding the implementation of the Law on Telecommunications. The subjects of application are enterprises providing terrestrial mobile telecommunications services and agencies, organizations and individuals related to network switching activities.
According to the Circular, subscribers can only switch networks when they are operating in two directions on the network of the transferring enterprise. The subscriber information registered at the transferring enterprise must match the information registered at the transferring enterprise. Specifically:
For individual subscribers, information must be consistent with the number and type of documents used to register the mobile subscriber number.
For organizational subscribers, the legal information or registration documents must match; if the SIM is given to an individual for use, that individual's personal information must also match the registration documents.
The Circular also clearly stipulates the minimum service usage time before being able to switch networks:
For subscribers winning the auction: comply with the provisions of Clause 3, Article 45 of Decree 115/2025/ND-CP.
For directly allocated subscriptions, the minimum activation period is 90 days prior to the time of network porting registration.
For subscribers switching networks for the second time or more, the minimum usage period is 60 days.

Regarding financial obligations, postpaid subscribers must complete all outstanding fees, and the fees incurred during the period must not exceed VND 500,000. In addition, postpaid subscribers cannot use international roaming services within 60 days before registering to switch networks.
The subscriber must also not have any disputes over the right to use the number, not violate the service provision contract and not be in the process of performing another network switching transaction.
The transferring enterprise may only refuse a network transfer request when the user does not meet the above conditions and must clearly notify the reason to the subscriber, the transferring enterprise and the competent state agency.
Circular 09/2025/TT-BKHCN takes effect from August 10, 2025.
