Institutional innovation is one of three strategic breakthroughs.

Comrade Nguyen Hai Ninh emphasized 5 requirements that directly impact the work of building legal documents, including: Institutional innovation is one of the three strategic breakthroughs; The country enters a new era, aiming to achieve 2 100-year goals; implementing the policy of streamlining the apparatus and organization of 2-level local governments associated with decentralization and delegation of power; implementing the goal of double-digit economic growth; requiring innovation in thinking about building legal documents from "leaning towards management" to both managing and creating development.

According to Minister Nguyen Hai Ninh, the five viewpoints on legal construction stated in Resolution No. 66 of the Politburo include: Ensuring the comprehensive and direct leadership of the Party. Legal construction work is a "breakthrough of breakthroughs" in perfecting institutions. Laws must remove difficulties and obstacles in practice, become competitive advantages, and create strong driving forces for development. Building a culture of law compliance, ensuring the rule of law and the rule of law. Investing in legal construction is investing in development. According to the World Bank's assessment in 2023, each point increase in the institutional index leads to an average GDP growth of 0.5-1% annually, depending on the specific country.

For the first time, the Party's direct leadership role is clearly institutionalized in the Law on Promulgation of Legal Documents.

Regarding the 5 results, during the past term, the Government Party Committee has led and directed the work of building legal documents to achieve some outstanding results. Firstly, advising on the issuance of the most Party documents on legal documents such as: Resolution 27 of the Party Central Committee on building a socialist rule-of-law state; Resolution 66, Regulation 178, Conclusion 119 of the Politburo; Notice 108 on the conclusion of General Secretary To Lam.

Second, for the first time, the direct leadership role of the Party has been clearly institutionalized in the Law on Promulgation of Legal Documents. The mechanism for direct leadership and direction of legal development work is demonstrated through the establishment of the Central Steering Committee on institutional and legal improvement headed by General Secretary To Lam; and the Steering Committee for reviewing and handling problems in the legal system of the Government headed by the Prime Minister; heads of ministries, Party Secretaries, and Ministers directly lead and direct legal development work, and are primarily responsible for the quality of policies and laws in their management areas. Third, the largest number of legal documents has been issued in one term. Notably, the Government has actively participated in amending the 2013 Constitution; submitting 121 laws and resolutions to the National Assembly for promulgation. At the upcoming 10th session of the National Assembly, it is expected to submit about 55 laws and resolutions.

The Government and the Prime Minister issued 991 legal documents; contributing to removing bottlenecks, forming a relatively synchronous, public and transparent legal system; creating a legal basis for successfully implementing socio-economic development targets of the term.

Fourth, promoting the publicity, transparency and accessibility of the legal system in conjunction with promoting digital transformation such as: The Prime Minister has directed the construction and operation of the National Law Portal with AI Law. As a result, from May 31 to October 10, there were 926,452 visitors and 143,427 questions answered by AI Law. Deploying the System to directly receive feedback and recommendations on legal documents. By October 10, 1,069 feedback and recommendations had been received, of which: 783 feedback and recommendations had been processed and responded to in the digital environment.

For the first time, a comprehensive review was conducted, clearly identifying 787 legal bottlenecks, publicly responding to the handling results on the National Law Portal; preparing to deploy a real-time monitoring system for the implementation of Resolution 66...

These new mechanisms are very practical and highly appreciated by the people, businesses and local authorities. In addition, the Government has submitted to the National Assembly many mechanisms to authorize legislative powers to the Government, helping the Government to proactively and flexibly handle many urgent issues in its operations.

Fifth, the control of power and the inspection and supervision of law-making work are strengthened. Law-making work is implemented separately according to Regulation 178 of the Politburo on power control...

The Minister of Justice also pointed out 5 shortcomings and limitations, including: The institutionalization of the Party's policies and guidelines in some areas is still slow. Some Party committees and leaders have not fully recognized the requirement for comprehensive and direct leadership of Party committees, considering legal development as purely professional work, lacking inspection and supervision. Some legal documents have not met the requirements of a creative and development-promoting legal system; still leaning towards management thinking. The overall structure of the legal system of a developed country has not been shaped; the synchronization, unity, stability and quality of drafting some documents are still limited. The debt situation of issuing detailed regulations has not been completely overcome.

Focus on early policy development

Minister Nguyen Hai Ninh proposed 5 solutions for legal development work, including: Continuing to enhance the responsibility of Party committees and leaders. Submitting to competent authorities for approval the Project on Completing the Structure of Vietnam's Legal System, as a basis for building legislative orientations for the next term and a strategy for developing the legal system until 2030, with a vision to 2045.

Focus on early policy development; improve the effectiveness of policy communication.

Strengthen, arrange, improve the quality of cadres doing construction work and deploy special regimes.

Comprehensive digital transformation, focusing on completing the national legal database and shared legal digital platforms.
