
The Ministry of Home Affairs has developed and is seeking comments on a draft Circular promulgating the List of regions with particularly difficult socio-economic conditions to serve as a basis for determining cases that can retire at a lower age than the retirement age under normal working conditions (hereinafter referred to as the draft Circular).
The Draft Circular details the List of regions with particularly difficult socio -economic conditions to serve as a basis for determining cases that can retire at a lower age as prescribed in Clause 3, Article 169 of the Labor Code and Article 5 of Decree No. 135/2020/ND-CP dated November 18, 2020 of the Government regulating retirement age.
The subjects of application are employees and employers specified in Clauses 1, 2 and 3, Article 2 of the Labor Code as well as agencies, organizations and individuals related to social insurance.
The time an employee worked before January 1, 2021 in a place with a regional allowance coefficient of 0.7 or higher or a place with a regional allowance of 25% or higher is determined as the time working in an area with particularly difficult socio-economic conditions to serve as a basis for determining cases where retirement can be at a lower age than the retirement age under normal working conditions.
The working time of employees from January 1, 2021 to before July 1, 2025 in areas with particularly difficult socio-economic conditions is applied according to the List of areas with particularly difficult socio-economic conditions to serve as a basis for determining cases where retirement can be at a lower age than the retirement age under normal working conditions issued with Circular No. 19/2021/TT- BLDTBXH dated December 15, 2021 of the Minister of Labor, War Invalids and Social Affairs.
The Draft List of Construction Zones of the Ministry of Home Affairs is located in the areas of 24 provinces/cities.
This list includes 360 communes, 8 special zones, 1 island (Hon Hai island in Phu Quy special zone), 1 light station (Thanh Nien-Hon Soi Den island light station, Quang Ninh); 1 village (Ho-Vit Thu Lu village in Kim Ngan commune, Quang Tri province), 1 other production and administrative unit (DK1 platform).
The eight special zones mentioned in this List of areas with particularly difficult socio-economic conditions include: Tho Chau, Truong Sa, Co To, Ly Son, Con Co, Hoang Sa, Bach Long Vi and Con Dao.
Ten provinces and cities with many areas with the most particularly difficult socio-economic conditions in the list of the Ministry of Home Affairs include: Tuyen Quang (40 communes), Lao Cai (36 communes); Lam Dong (1 island, 33 communes), Cao Bang (30 communes), Dien Bien (30 communes); Lai Chau (28 communes); Quang Ngai (1 special zone, 27 communes); Son La (27 communes); Nghe An (22 communes); Da Nang city (19 communes, 1 special zone).
