Proposal to fine 40 million and deduct all driving license points for car drivers driving in the wrong direction or reversing on the highway

In addition to the maximum fine of 40 million, the Traffic Police Department proposed deducting all 12 driving license points of car drivers who drive in the wrong direction and reverse on the highway.

In the latest draft (4th time) of the Decree regulating administrative sanctions for violations of road traffic order and safety; deduction of points, and restoration of driving license points that the Ministry of Public Security has just submitted to the Government, the drafting agency has many proposals related to violations on highways.

Driving the wrong way on the highway always carries the risk of causing traffic accidents.

If approved, the new Decree will take effect from January 1, 2025.

Accordingly, the draft proposes to increase the fine from 16-18 million VND (currently in effect) to 30-40 million VND for drivers driving in the wrong direction on the highway or reversing on the highway, except for priority vehicles on emergency missions as prescribed.

Proposal to increase the fine from 10-12 million (currently applied) to 12-14 million VND for stopping or parking on the highway in the wrong place.

Not signaling with emergency lights and placing signs or warning lights at least 150 m behind the vehicle when stopping or parking in case of technical problems or other force majeure forcing the vehicle to stop or park on part of the lane on the highway; making a U-turn on the highway.

In addition, the act of driving in the emergency lane or on the highway shoulder; not complying with regulations on safe distance for the vehicle in front when driving on the highway is proposed to be fined from 4-6 million VND.

In addition to administrative sanctions, the Traffic Police Department also proposed deducting all 12 driving license points from drivers who drive in the wrong direction on the highway or reverse on the highway.

Criminal prosecution may be used as a deterrent.

According to the Traffic Police Department, the situation of cars driving in the wrong direction on the highway is not uncommon in recent times. Although authorities have frequently warned and severely punished, many drivers still disregard the law and ignore the risk of causing traffic accidents.

Regarding the cause, the representative of the Traffic Police Department pointed out that the awareness of a number of traffic participants is not high, leading to the situation of violations still occurring commonly. As a result, there are still particularly serious accidents caused by the subjective fault of the driver.

Without cars, many motorbikes brazenly enter the highway even though they know this is wrong.

In particular, violations of regulations on the highway are complicated, with behaviors such as reversing, driving in the wrong direction, parking on the highway, motorbikes entering the highway, stopping, picking up and dropping off passengers... still occurring.

"The act of driving in the wrong direction on highways poses many risks of traffic accidents because vehicles move at high speed, making it difficult to handle unexpected situations, especially at night, in the rain or in unfavorable weather," the Traffic Police Department said.

Many serious traffic accidents, causing great loss of life and property, occur due to the lack of compliance with regulations on ensuring traffic order and safety on the highway. Therefore, increasing the penalty for some acts is absolutely necessary to raise the awareness of drivers and build a civilized traffic culture environment.

Speaking further with reporters, lawyer Nguyen Anh Thom ( Hanoi Bar Association) said that driving a car in the wrong direction on the highway is a serious violation of the provisions of the Road Traffic Law.

According to experts, any driver must know that the highway is a place with lanes that allow vehicles to run at a maximum speed of up to 120 km/h. Meanwhile, cars are considered a source of high danger, if the driver does not have the consciousness to obey the law, driving in the wrong direction or reversing, it is very easy to cause a catastrophic accident.

With the statistics on highway violations that have occurred recently, the lawyer recognized that "criminal prosecution is needed because violations on highways always pose a very high risk of causing serious traffic accidents, threatening the lives, health, and property of others."
