Complete investigation into the death of a 9-month-old fetus

On October 20, according to Thanh Nien reporter's source, the Hong Dan District Police Investigation Agency ( Bac Lieu ) has just sent a notice of investigation conclusion on the death of a 9-month-old fetus to the family of Mr. Nguyen Hoang Nghiep (34 years old, residing in Ta Ky hamlet, Ninh Hoa commune, Hong Dan district) and confirmed that they will not prosecute the case.

On duty without technical errors

According to the conclusion announcement of the Hong Dan District Police Investigation Agency, the Professional Council concluded that on duty on May 24, the doctor in charge of the obstetrician NTB (32 years old, Nghiep's wife) correctly followed the procedures and professional regulations of the Ministry of Health on medical examination, treatment and patient care, and there were no technical errors.

Based on the medical records, the Professional Council concluded that the pregnant woman B. showed signs of labor (signs of birth) at 5:00 a.m. on May 24. The total labor time, from the start of labor until the cesarean section to deliver the fetus, was 15 hours and 12 minutes. This time is within the normal labor range. The on-duty team followed the regulations and labor monitoring protocol of the Ministry of Health.

"When the family requests a doctor to perform a cesarean section, the doctor must examine and evaluate the progress of labor and decide whether to perform a cesarean section or not based on professional regulations. At the same time, he must explain to the patient and family about the condition and the next treatment direction. According to the regulations of the Ministry of Health, the decision to perform a cesarean section must follow professional instructions, not the family's request. Therefore, recording the doctor's orders through the medical records is appropriate at the time the mother's family requests a cesarean section. When a cesarean section is indicated, the doctor will call for a consultation to perform an emergency surgery as soon as possible without waiting for any other tests or instructions," the conclusion stated.

What did the mother's family say?

Mr. Nghiep said that for many months, his family has been very upset and waiting for the investigation agency to clarify whether the death of the fetus and child of the couple was due to the negligence of some doctors and nurses at the Hong Dan District Medical Center or not.

According to Mr. Nghiep, at around 10 p.m. on May 21, he took his wife, Ms. B., to Hong Dan District Medical Center to give birth. Ms. B. was 9 months and 4 days pregnant at the time, and the fetus was a girl, weighing 3.2 kg. After the examination, Ms. B. was admitted to the hospital by the doctor. At around 2 p.m. on May 24, Ms. B. showed signs of labor and was taken to the delivery room. At 4:30 p.m. the same day, Ms. B. still had not given birth, so her family was worried and asked the doctor to perform a cesarean section. However, the doctor on duty said that Ms. B. could give birth normally, so they continued to monitor her. At around 5 p.m. the same day, Ms. B. still had not given birth, and her health was gradually weakening, so the family continued to ask the doctor to perform a cesarean section, but the doctor explained, "The mother can give birth normally, so there is no need for a cesarean section."

At this time, Mr. Nghiep saw that his wife's health was very weak, her face pale. At about 10 p.m. the same day, the doctor immediately took Ms. B. into the operating room to deliver the baby. However, only about 30 minutes later, a doctor announced that the newborn baby had died. Mr. Nghiep said that some of the doctors and nurses on duty at the Hong Dan District Health Center were negligent, leading to the death of the fetus. Because before that, the family had requested a cesarean section many times to deliver the baby but were refused by the doctor (?).

In response to the request of Mr. Nghiep's family to clarify the cause of the fetus's death, on May 25, the Hong Dan District Police Department conducted an autopsy on the fetus, took statements from relevant people and sealed the medical records to serve the investigation.

According to Mr. Nghiep, after the incident, representatives of the Hong Dan District Medical Center visited the family, expressed condolences, and provided 30 million VND for the funeral. Currently, the family has filed a petition with the Hong Dan District People's Court to sue the Hong Dan District Medical Center for compensation for mental and material losses to the family, due to the doctor's negligence that caused the death of the fetus of the couple.
