To detail the laws and resolutions passed by the National Assembly at the 8th Session, the Government, the Prime Minister, the Ministers, and the Heads of ministerial-level agencies must issue 130 documents. Of these, there are a number of laws that require the issuance of many detailed documents, such as the Electricity Law (29 documents), the Law amending 9 Laws in the financial sector (15 documents), the Law on Cultural Heritage (16 documents), etc.
On the afternoon of December 25, at the Government headquarters, a conference was held to disseminate and implement laws and resolutions passed at the 8th session of the 15th National Assembly.
The conference was organized by the Government, the National Assembly Standing Committee, and relevant agencies, chaired by Prime Minister Pham Minh Chinh and National Assembly Chairman Tran Thanh Man.
At the Conference, on behalf of the Government, Deputy Prime Minister Le Thanh Long presented a summary report of the Government on the implementation of laws and resolutions passed by the 15th National Assembly at the 8th Session.
Completed the largest volume of legislative tasks since the beginning of the term
Deputy Prime Minister Le Thanh Long said that in recent times, under the Party's close and timely leadership and direction; the National Assembly's proactive, accompaniment and close supervision; the Government and Prime Minister's drastic management and administration; and the close coordination of sectors, levels and localities, the work of building and organizing law enforcement continued to be carried out in a systematic manner with extremely important results.
The Government, the Prime Minister, ministries, branches and localities have promoted the spirit of responsibility, proactively and resolutely implemented many synchronous solutions such as: (1) stepping up legal review to promptly remove institutional "bottlenecks" and unblock resources for development; proactively reporting to competent authorities for appropriate policy responses; (2) The Government and the Government Standing Committee thoroughly discussed proposals, projects and draft legal documents, proposing many solutions to improve the effectiveness of law enforcement organization; (3) focusing resources to speed up the drafting and promulgation of detailed regulations.
Since the beginning of 2024, the Government has organized 10 thematic meetings on law-making (reviewing and commenting on more than 70 proposals for law-making and draft laws and draft resolutions); The Prime Minister established a Steering Committee to review and handle legal problems, assigning the Ministry of Justice to preside over and coordinate with ministries and agencies to urgently review, research, and submit to the National Assembly for amendments and supplements to many important laws (submitting to the National Assembly for comments on 19 draft laws, passing 28 draft laws, and 6 draft normative resolutions). Along with submitting the Laws, the Government has issued 159 decrees, the Prime Minister has issued 23 decisions, and the Ministers have issued 832 circulars.
At the 8th session (October 2024), the National Assembly completed the largest volume of legislative tasks since the beginning of the term, passing 18 laws, 4 legal resolutions, giving first opinions on 10 draft laws and reviewing many other important reports, most of which were submitted by the Government.
Of the 18 laws and 4 resolutions, 1 law will take effect from December 1, 2024; 2 laws will take effect from January 1, 2025; 1 law will take effect from January 15, 2025; 1 law will take effect from February 1, 2025; 2 laws will take effect from July 1, 2025; 1 law will take effect from January 1, 2026; 2 resolutions will take effect from April 1, 2025; the remaining resolutions will take effect from the date of approval by the National Assembly.
Unleash all resources to bring the country into a new era
Deputy Prime Minister Le Thanh Long said that at the 8th Session, the Government submitted to the National Assembly laws to ensure state management requirements, encourage creativity, promptly remove difficulties and bottlenecks, promote growth, liberate production capacity, and open up all resources for development; strengthen decentralization and delegation of power; reduce and simplify administrative procedures, investment conditions for production and business, reduce compliance costs, and create favorable conditions for people and businesses (Law amending 9 laws chaired by the Ministry of Finance; Law amending 4 laws chaired by the Ministry of Planning and Investment; Resolution on pilot implementation of commercial housing projects through agreements on receiving land use rights or having land use rights; Resolution on specific mechanisms to remove difficulties and obstacles for projects and land in inspection, examination and judgment conclusions in Ho Chi Minh City, Da Nang City, and Khanh Hoa Province).
At the 8th Session, the Government submitted to the National Assembly a timely legal corridor for new issues and trends such as data management and use, digital technology industry development, nuclear power and offshore wind power... creating a legal framework, aiming to successfully implement the digital transformation revolution, socio-economic development (Electricity Law, Data Law...)
The Government has submitted to the National Assembly laws on national defense and security, ensuring a full legal basis to perform well the tasks of national defense and security...; stepping up the fight against crime and corruption, ensuring social order and safety (Law on Prevention and Combat of Human Trafficking; Law on People's Air Defense...); promulgating laws to remove difficulties and obstacles in drug management activities, continuing to reform administrative procedures in medical examination and treatment activities, improving the quality of life for people (Law on amending and supplementing a number of articles of the Law on Pharmacy, Law on amending and supplementing a number of articles of the Law on Health Insurance).
Bills and draft resolutions were passed by the National Assembly with approval rates of over 90% (some laws were passed with 100% of delegates, such as the Law on People's Air Defense).
The contents of laws and resolutions closely follow the Party's policies and guidelines, are unified and synchronized with the legal system, ensuring that the law is implemented fairly, strictly, consistently, promptly, effectively, efficiently, transparently, without creating loopholes for negative behaviors, corruption, group interests, local interests, and unleashing all resources to bring the country into a new era, an era of national growth.
The above results are the efforts of the entire political system, the close coordination between the agencies of the National Assembly with the Government and relevant agencies, especially the active and proactive preparation of the Ministry of Planning and Investment, the Ministry of Finance, the Ministry of Justice and the Government Office in the process of consulting and proposing the promulgation of the Law amending 9 laws and the Law amending 4 laws to promptly remove institutional bottlenecks and unblock resources for development, the Deputy Prime Minister stated.
Implementation of laws and resolutions
Immediately after the end of the National Assembly session, the ministries urgently researched and advised the Prime Minister to issue a Plan to implement laws and resolutions (Electricity Law, Data Law). A number of ministries drafted a Ministerial Decision to implement the laws and are collecting opinions from relevant ministries and branches (Law on Notarization, Law on amending and supplementing a number of articles of the Law on Officers of the Vietnam People's Army, etc.).
In order to promptly bring new laws and resolutions passed by the National Assembly into life, the Central Council for Coordinating the Dissemination and Education of Law has promptly issued documents guiding ministries, branches and localities in disseminating laws and resolutions. The ministries in charge of drafting organized the compilation of documents introducing the basic content of new laws to be posted on the National Electronic Information Portal for Dissemination and Education of Law. The ministries, branches and localities have updated and posted the full text of the documents on the Electronic Information Portal/Website for easy access by officials and people.
After the laws and resolutions were passed by the National Assembly at its 8th Session, the ministries proactively reviewed and compiled a list of detailed regulatory documents to submit to the Prime Minister for promulgation (Decision No. 1610/QD-TTg dated December 19, 2024).
Accordingly, to detail the laws and resolutions passed at the 8th Session, the Government, the Prime Minister, the Ministers, and the Heads of ministerial-level agencies must issue 130 documents. Up to now, according to the report of the Ministry of Justice, a number of ministries have proactively drafted and sent documents to the Ministry of Justice for review to ensure progress and deadline for submitting and promulgating detailed regulations.
The Ministry of Justice has proactively coordinated with ministries to review and send notices to the People's Councils and People's Committees at the provincial level on the contents of laws and resolutions assigned to local authorities for detailed regulations. Accordingly, the People's Committees of provinces and centrally run cities must issue documents to detail 3 contents assigned in the Law on Urban and Rural Planning, the Law on Fire Prevention, Fire Fighting and Rescue. In particular, the People's Committee of Hai Phong city must issue documents to detail 1 content assigned in the National Assembly's Resolution on the organization of urban government in Hai Phong city.
The volume of documents that need to be issued is huge in a short period of time.
Regarding the tasks in the coming time, the Government's report clearly stated and thoroughly grasped the viewpoints and guiding thoughts of General Secretary To Lam, the direction of Prime Minister Pham Minh Chinh, and National Assembly Chairman Tran Thanh Man on innovation in law-making work, especially the viewpoint of innovating thinking in law-making, aiming to build and perfect the legal system to protect the legitimate rights and interests of individuals and organizations; promote economic and social development to contribute to building a progressive, harmonious and developed society.
Implement the direction of competent authorities on strongly innovating thinking in law-making work; fighting waste and innovating and arranging the apparatus to be "Slim - Lean - Strong, Effective - Efficient - Effective".
The establishment and implementation of the annual law and ordinance development program must be based on practice and fully, correctly and promptly institutionalize the Party's policies and guidelines; contribute to removing bottlenecks, promptly reactivating stagnant and wasted social resources; and create a legal corridor for new issues and new trends.
Urgently send the results of reviewing legal documents that need to be amended and supplemented related to the reorganization of the apparatus to the Ministry of Justice for synthesis and reporting to the Government; in which, for the amendment of laws related to the names and tasks of ministries and agencies that will change after the reorganization and streamlining of the apparatus, it will be considered and reported to the Government to request the National Assembly Standing Committee to give opinions on the content, at the same time with the decision to add it to the Agenda of the 9th Extraordinary Session.
Continue to review and propose amendments to documents to promote decentralization, delegation of authority, and authorization; simplify administrative procedures to create favorable conditions for businesses and people.
Urgently propose amendments or amend legal documents according to the review results of the Working Group, implement Project 06 and reduce administrative procedures.
Regarding the implementation of laws, ministries shall promptly submit to the Prime Minister for promulgation or promulgate within their authority plans for the implementation of laws and resolutions. Provincial People's Committees shall proactively promulgate plans for the implementation of laws and resolutions in their localities; focus on reviewing, researching, preparing necessary conditions and organizing the implementation of assigned powers and tasks, especially new powers and tasks added in laws and resolutions of the National Assembly.
Concentrate resources on promulgating on schedule 83 documents detailing laws passed from the 7th Session and earlier and promulgating on schedule 130 documents detailing laws and resolutions passed by the National Assembly at the 8th Session, especially 69 documents detailing laws or contents taking effect in December 2024 and early 2025. With a huge volume of documents to be promulgated in a short period of time, ministries, branches and localities must "join hands", contribute and enhance responsibility in coordinating drafting, appraisal and commenting to promulgate documents that ensure quality, progress and take effect at the same time as laws and resolutions.
