Will I be fined for not changing the name when buying and selling a car?

In the case of buying and selling cars

Pursuant to Point l, Clause 7, Article 30 of Decree 100/2019/ND-CP, it is stipulated as follows:

“ 7. A fine of VND 2,000,000 to VND 4,000,000 shall be imposed on individuals and VND 4,000,000 to VND 8,000,000 shall be imposed on organizations that are owners of automobiles, tractors, specialized motorbikes and similar vehicles that commit one of the following violations:

g) Handing over the vehicle or allowing an employee or representative to drive the vehicle to commit a violation specified in Point e, Clause 3, Point m, Clause 5, Article 23 of this Decree or directly driving the vehicle to commit a violation specified in Point e, Clause 3, Point m, Clause 5, Article 23 of this Decree.

h) Handing over the vehicle or allowing an employee or representative to drive the vehicle to commit a violation specified in Point a and Point d, Clause 2, Article 24 of this Decree or directly driving the vehicle to commit a violation specified in Point a and Point d, Clause 2, Article 24 of this Decree.

i) Handing over the vehicle or allowing an employee or representative to drive the vehicle to commit a violation specified in Point b, Clause 2, Article 24 of this Decree or directly driving the vehicle to commit a violation specified in Point b, Clause 2, Article 24 of this Decree.

l) Not completing the vehicle registration procedure (to transfer the vehicle owner's name in the Vehicle Registration Certificate to one's name) as prescribed when purchasing, being given, being gifted, being allocated, being transferred, or inheriting assets such as cars, tractors, specialized motorbikes, or vehicles similar to cars .

Thus, buying a car but not registering the vehicle will be fined from 2,000,000 VND to 4,000,000 VND for individuals, from 4,000,000 VND to 8,000,000 VND for organizations.

In the case of buying and selling motorbikes

According to the provisions of Clause 4, Article 30 of Decree 100/2019/ND-CP, amended by Point b, Clause 17, Article 2 of Decree 123/2021/ND-CP:

“ 4. Fines from VND 400,000 to VND 600,000 for individuals, from VND 800,000 to VND 1,200,000 for organizations that are owners of motorbikes, scooters and similar vehicles that commit one of the following violations:

a) Not completing the vehicle registration procedure (to transfer the vehicle owner's name in the Vehicle Registration Certificate to your name) as prescribed when purchasing, being given, being gifted, being allocated, being transferred, or inheriting property that is a motorbike, scooter, or vehicle similar to a motorbike.

b) Not completing the procedures to change the Vehicle Registration Certificate as prescribed when changing the vehicle owner's address or in other cases as prescribed .

Thus, in case of buying a used motorbike but not doing so, individuals will be fined from 400,000 VND to 600,000 VND, and organizations from 800,000 VND to 1,200,000 VND.

Pursuant to Clause 15, Article 30 of Decree 100/2019/ND-CP amended by Point r, Clause 17, Article 2 of Decree 123/2021/ND-CP, if you buy a used vehicle, including cars and motorbikes, without registering the vehicle name, you will only be fined and there will be no additional penalties.
