The Ministry of Public Security is seeking comments on a draft Resolution on abolishing notarization of contracts and confirmation of marital status when conducting transactions of buying, selling, and transferring real estate and means of transport such as cars or motorbikes.
This draft is built on the principles of administrative procedure reform, digital transformation and thorough exploitation of digitized data in the National Population Database and specialized systems.
According to the Ministry of Public Security, if personal information, marriage, and assets have been authenticated, synchronized, and "cleaned" in the data system, people will not need to submit paper copies, notarize, or re-authenticate when carrying out transaction procedures.

The Draft Resolution clearly states that in transactions of buying, selling, transferring, donating, mortgaging, inheriting land use rights or registering vehicle ownership, people will not have to submit a certificate of marital status if this data has been updated and authenticated in the National Population Database or the Electronic Civil Status Database.
At the same time, notarization or contract authentication procedures will also be eliminated in cases where the transaction parties have been identified and electronically authenticated at a high level according to legal regulations.
The contract is then created, signed and stored on an electronic platform, with the ability to retrieve, check and ensure data integrity as well as legal value equivalent to a traditional notarized contract. In addition, people do not need to present copies of personal documents or property documents if the information is already in the database and has been successfully looked up and verified by the receiving agency.
The abolition of notarization, confirmation of marital status and the elimination of copies of personal documents are considered important steps in the roadmap to build a digital administration, towards "one declaration - lifelong use".
When national databases are fully connected and synchronized, people will only need to make transactions using personal identification codes or the VNeID application, instead of preparing a series of paper documents as before.
The Ministry of Public Security said that the draft Resolution is being consulted with ministries, branches and localities, and will then be submitted to the Government for consideration and promulgation in the near future. If approved, this will be a major breakthrough in administrative procedure reform and digitalization of civil transactions in Vietnam.
