
Mostly related to land sector
Of the total number of projects facing difficulties and problems, 254 are non-budget investment projects. It is noteworthy that 123 of these non-budget projects are related to land. Similarly, in industrial zones (IPs), 31/42 projects are facing problems related to land.
The main difficulties and problems are related to the conversion of annual land lease payments to one-time land lease payments; compensation, site clearance, land price determination; environmental licenses, conversion of forest use purposes, conversion of land use purposes, land lease; overlapping mineral planning approved by competent authorities; no zoning plan. The project must adjust the detailed planning to reserve 20% of residential land for social housing according to regulations; the project has not completed site clearance but is not included in the list of projects requiring land acquisition for implementation; the project is not included in the housing development plan, the project has no access road, is stuck in construction planning, investment procedures...
Many projects are stuck with legal procedures on construction (due to the lack of regulations on approving master plans, which previously belonged to the district level); procedures for adjusting investment progress; projects related to policies to support investment in industrial park infrastructure for aluminum electrolysis projects.
Removing difficulties and obstacles
Currently, some projects have major problems with compensation and site clearance, and the responsibility for site clearance belongs to the State agency; at the same time, land recovery must ensure land funds for resettlement and resettlement for households according to the provisions of Clause 2, Article 912 of the 2024 Land Law. However, currently, the land fund for resettlement in localities is still very limited, leading to difficulties in compensation and site clearance.
Particularly for projects in Tuyen Lam Lake National Tourist Area, implementing Decision No. 704/QD-TTg dated May 12, 2014 of the Prime Minister, Decision No. 1968/QD-UBND dated September 7, 2016 of the Provincial People's Committee, on the general planning of Tuyen Lam Lake National Tourist Area, Notice No. 191/TB-VPCP of the Government Office dated July 22, 2016, requiring strict implementation of natural forest closure: construction density and architectural standards in some areas have changed (for unfinished projects, reduce about 40% density compared to the approved planning in Decision No. 2117/QD-UBND).
Therefore, some investors in Tuyen Lam Lake National Tourist Area have to adjust the project scale, architectural standards... to comply with current regulations. Problems in changing the purpose of forest use to other purposes affect the initial investment goals and plans of investors. In addition, some projects according to the previous planning do not have access roads to the project, making it difficult to implement, and in some cases, the project has to be terminated due to the lack of or infeasible traffic plans.
At the meeting to listen to the Department of Finance report on the review of difficult and stuck non-budget investment projects in the province, Chairman of the Provincial People's Committee Ho Van Muoi requested departments and branches to consider removing difficulties and obstacles for projects according to the viewpoint of doing easy projects first, big projects first, necessary projects first... The Chairman of the Provincial People's Committee requested the Department of Finance to review and provide full information about projects in the past, present and future; propose solutions, determine the authority to resolve at all levels and which issues need to be reported to the Standing Committee of the Provincial Party Committee, People's Council...
On the other hand, it is divided into 6 areas managed by 6 vice presidents and the directors of departments and branches are permanent... to directly direct the removal of difficulties and obstacles that the projects are facing. In particular, for projects that are eligible for revocation, the procedures for project revocation will be carried out.
Through review, the total number of projects facing difficulties and problems in the province is 296 projects, of which 228 projects are under the authority of the Provincial People's Committee. Also through review, among these projects, there are 42 projects in industrial parks and 254 projects outside industrial parks. Accordingly, the Provincial People's Committee held a meeting to identify difficulties and problems and agree on solutions; at the same time, committed to directing solutions for each project in the coming time.
