The Prime Minister directed to continue to promote the reduction and simplification of administrative procedures to serve people and businesses.

The Directive clearly states that, in recent times, administrative procedure reform and business environment improvement associated with national digital transformation have been a key task of the Government. The Prime Minister has issued many directive documents; many programs, projects and plans have been implemented; ministries, branches and localities have made great efforts. Administrative procedure reform has achieved positive results, many of Vietnam's indicators have been upgraded, contributing to socio -economic growth, improving the business environment, enhancing national competitiveness and reducing costs for society.

However, through the implementation results at ministries, branches, localities and the reflections and recommendations of people and the business community, there are still shortcomings and limitations in administrative procedure reform such as: (1) Some regulations and administrative procedures in some legal documents are still overlapping and contradictory; (2) Regulations on the authority to receive and resolve some administrative procedures still go through many levels and intermediate stages; (3) Internal administrative procedures in each ministry, agency, locality and between state administrative agencies are still complicated; (4) The reduction and removal of obstacles for businesses and people are still limited; in some agencies, units, localities, especially at the grassroots level, there is still harassment and negativity; (5) The reception and resolution of administrative procedures are mainly by the traditional method of paper documents, according to administrative boundaries.

The causes of the above-mentioned shortcomings and limitations include both subjective and objective causes, of which the subjective causes are the main ones, such as: (1) Administrative procedure reform in a number of ministries, branches and localities has not yet received due attention; (2) Working habits in traditional ways have not kept up with advances in science, technology and engineering; (3) The qualifications of a number of cadres, civil servants and public employees are still limited, not fully promoting their roles and responsibilities in performing public duties; (4) Coordination between agencies and units is still lacking in initiative, closeness and timeliness; (5) Information technology infrastructure is still weak and unsynchronized, many systems have been invested in for a long time and have not been upgraded or developed.

In order to promptly rectify and overcome the above-mentioned shortcomings and limitations and continue to promote the reduction and simplification of administrative procedures at ministries, branches and localities to serve people and businesses, the Prime Minister requests Ministers, Heads of ministerial-level agencies, Government agencies, Chairmen of People's Committees of provinces and centrally-run cities to focus on directing and organizing the strict, complete, timely and effective implementation of tasks and solutions on administrative procedure reform in programs, projects and plans approved by the Government and the Prime Minister, and Resolution No. 01/NQ-CP, Resolution No. 02/NQ-CP dated January 5, 2024 of the Government, the Key Administrative Procedure Reform Plan for 2024, Directive No. 27/CT-TTg dated October 27, 2023, Directive No. 04/CT-TTg dated February 11, 2024 of the Prime Minister, focusing on: focus on a few tasks.

Reform and cut administrative procedures right in the process of drafting legal documents

Regarding reform and reduction of administrative procedures, the Prime Minister requested Ministers, Heads of ministerial-level agencies and Government agencies to strictly implement reform and reduction of administrative procedures right in the process of drafting legal documents, strengthen strict control, assess the impact of specific policies on administrative procedure regulations, carry out consultation well (strengthen consultation in the electronic environment), appraise and examine projects and draft legal documents, ensure that administrative procedures are regulated by the right authority, necessary, reasonable, feasible, implemented in the electronic environment and with the lowest compliance costs. At the same time, rectify, review and propose amendments to regulations to avoid causing inadequacies and conflicts in assigning localities to promulgate documents regulating components of administrative procedures in accordance with the provisions of the Law on promulgation of legal documents.

Focus on drafting documents under the authority of the Government, Prime Minister, Ministers, and Heads of ministerial-level agencies to immediately implement plans to reduce and simplify regulations related to business activities; decentralization in handling administrative procedures; priority groups of internal administrative procedures; administrative procedures and citizen papers related to population management approved by the Government and Prime Minister in the direction of one Decree amending many Decrees, one Decision amending many Decisions, one Circular amending many Circulars and prioritizing the implementation of shortened procedures according to regulations. At the same time, draft and submit to the National Assembly and the National Assembly Standing Committee for promulgation documents under their authority to implement plans to reduce and simplify regulations according to the approved roadmap.

Urgently review, cut down, and simplify administrative procedures in the fields of land, social housing, credit, and mineral resources.

The Prime Minister also requested Ministers, Heads of ministerial-level agencies, and Government agencies to urgently review and propose plans to reduce and simplify administrative procedures in assigned fields, especially administrative procedures in the fields of land, social housing, credit, mineral resources, etc. and licenses related to business activities according to the 2024 Key Administrative Procedure Reform Plan to be sent to the Government Office no later than May 2024 for synthesis and reporting to the Prime Minister. Organize the implementation of the plan immediately after approval by the Prime Minister.

At the same time, promptly and fully publicize internal administrative procedures between state administrative agencies and between ministries, agencies and departments, divisions and equivalents; correctly determine the scope and authority to issue internal administrative procedures to review, simplify, and ensure the goals and requirements set out in Decision No. 1085/QD-TTg dated September 15, 2022 of the Prime Minister.

Focus on implementing the reduction and simplification of administrative procedures related to Criminal Records according to the Reduction and Simplification Program after being approved by the Prime Minister to reduce the unreasonable requirement to submit Criminal Records in the implementation of administrative procedures, ensuring progress, substance and efficiency. Strengthen communication work in administrative procedure reform so that people and the business community know and accompany the Government.

Maintain only the administrative procedures that are truly necessary, with the lowest compliance costs.

The Prime Minister requested the Chairmen of the People's Committees of provinces and centrally run cities to promptly publicize all internal administrative procedures between the provincial People's Committees and departments, branches, and district People's Committees; correctly determine the scope and authority to issue internal administrative procedures to review, simplify, and ensure the goals and requirements set out in Decision No. 1085/QD-TTg dated September 15, 2022 of the Prime Minister.

The Ministry of Justice, the legal organizations under ministries, ministerial-level agencies, and the Departments of Justice under the People's Committees of provinces and centrally-run cities, within their assigned functions, tasks, and powers, shall coordinate with relevant agencies to improve the quality of appraisal of regulations on administrative procedures in draft legal documents, ensuring that only administrative procedures that are truly necessary, reasonable, legal, and have the lowest compliance costs are issued and maintained.

The Prime Minister assigned the Ministry of Justice to preside over and coordinate with the Government Office and ministries, branches and localities to study and consider reporting to the National Assembly to amend the provisions of the Law on promulgation of legal documents on administrative procedures in the draft legal documents, resolutely cut unnecessary administrative procedures, especially administrative procedures to implement measures of a specific nature suitable to the socio-economic development conditions of the locality.

Closely coordinate with ministries and agencies to review, research, and propose priority for inclusion in the Law and Ordinance Development Program of draft laws to implement reduction and simplification options, ensuring scientific and feasible nature.

Innovation of one-stop shop and inter-connected one-stop shop mechanisms in handling administrative procedures

Regarding reform of administrative procedure implementation, the Prime Minister assigned Ministers, Heads of ministerial-level agencies, Government agencies, Chairmen of People's Committees of provinces and centrally run cities to continue to effectively implement the innovation of the one-stop shop and inter-connected one-stop shop mechanism in handling administrative procedures, focusing resources on accelerating the digitization of records and results of handling administrative procedures, linking digitization with the performance of tasks of cadres, civil servants and public employees in the process of receiving and handling administrative procedures; promoting the reuse of digitized data among ministries, branches and localities through connection and data sharing; upgrading the synchronous information technology infrastructure system from the central to local levels in accordance with the requirements of national digital transformation, ensuring information security and safety, promoting connection, integration and sharing of data to serve the direction, administration and handling of administrative procedures, and provision of public services.

Focus on deploying priority groups of online public services to review and restructure the integration process and provide it on the National Public Service Portal in 2024 according to Decision No. 206/QD-TTg dated February 28, 2024 of the Prime Minister. At the same time, review, evaluate, and restructure the process for online public services that are being integrated and provided on the National Public Service Portal, ensuring the principle of putting users at the center.

VNeID is the only account used to carry out administrative procedures.

Focus on successfully implementing the Project on developing applications of population data, identification and electronic authentication to serve national digital transformation in the period of 2022-2025 with a vision to 2030 (Project 06), especially the tasks and solutions in Directive No. 04/CT-TTg dated February 11, 2024 of the Prime Minister to completely handle bottlenecks in institutions, information technology infrastructure, data, human resources and funding.

Ensure the necessary conditions to implement the conversion to using VNeID as the sole account in performing administrative procedures and providing public services in the electronic environment from July 1, 2024 according to Decree No. 59/2022/ND-CP dated September 5, 2022 of the Government.

Strictly organize the reception and timely resolution of feedback and recommendations from people and businesses; strengthen dialogue and thoroughly resolve problems and difficulties regarding mechanisms, policies and administrative procedures; improve the quality of human resources performing administrative procedure settlement work.

Continue to carry out inspection and examination of administrative procedure reform to improve public ethics, strengthen administrative discipline and order, promptly handle cases of evasion, shirking, fear of mistakes, and fear of responsibility. Periodically, monthly publicize the results of service quality assessment for people and businesses according to Decision No. 766/QD-TTg dated June 23, 2022 of the Prime Minister on the National Public Service Portal, Ministry-level and Provincial-level Public Service Portals, and electronic information portals of ministries, agencies, and localities.

Create the most favorable conditions for people and businesses to access and perform administrative procedures and public services regardless of administrative boundaries.

Regarding the pilot implementation of the One-Stop Shop Model to provide public services in the direction of combining the One-Stop Shops of administrative units at all levels in the area: Hanoi, Ho Chi Minh City, Binh Duong, Quang Ninh preside, coordinate with the Government Office and relevant agencies to organize the pilot implementation in 2024 before summarizing and expanding in 2025 with the goal of creating the most favorable conditions for people and businesses to access and implement administrative procedures and public services regardless of administrative boundaries, maximizing the scope of receiving administrative procedures at one location on the basis of applying information technology, promoting digital transformation, improving professionalism and promoting the responsibility of the one-stop shop in monitoring and urging the settlement of administrative procedures at ministries, branches and localities.

The Government Office is assigned to preside over and coordinate with ministries, branches, localities, experts and relevant agencies to develop and submit to the Government for promulgation the Program on reducing licenses and innovating licensing activities at ministries, branches and localities in the period of 2025-2030 to continue to substantially and effectively reduce administrative procedures, creating a favorable and transparent production and business environment, contributing to promoting socio-economic development, to be completed in December 2024.

Urgently develop a model document on the One-Stop Service Department providing public services in the direction of combining the One-Stop Service Departments of administrative units at all levels in the area, to be completed in the second quarter of 2024, and report to the Prime Minister's Administrative Procedure Reform Working Group for comments and directions to organize a pilot in 2024 in the following localities: Hanoi, Ho Chi Minh City, Binh Duong, Quang Ninh.

The Government Office studies and completes criteria for assessing service quality and satisfaction of people and businesses in performing administrative procedures and public services in real time in the electronic environment according to Decision No. 766/QD-TTg dated June 23, 2022 of the Prime Minister, ensuring substance and efficiency according to criteria on service quality, usefulness and ease of use.

The Prime Minister also requested the Prime Minister's Working Group on Administrative Procedure Reform to further promote its role in directing and promoting the implementation of administrative procedure reform in ministries, branches and localities; closely coordinate with the Prime Minister's Advisory Council on Administrative Procedure Reform to promptly listen to, identify and handle obstacles and difficulties in mechanisms, policies and administrative procedures that are barriers to production and business activities of enterprises and people's lives.
