What is the principal's responsibility if there is illegal collection and expenditure?

(NLDO)- For the situation of illegal revenue and expenditure, the Department of Education and Training of Ho Chi Minh City will consider strictly handling the responsibility of the head of the unit.

Ms. Nguyen Thi Nhat Hang, Deputy Director of the Department of Education and Training of Ho Chi Minh City, said   For educational institutions that allow revenue and expenditure to be made in violation of regulations, the Department will consider and strictly handle the responsibility of the head of the unit for the violation. The forms of handling include: Reviewing responsibility; considering disciplinary measures if a serious incident occurs that affects the reputation of the industry, which can be reprimands, warnings; or even more severe discipline that can affect competition and work positions. Making compliance with regulations on financial revenue and expenditure a prerequisite criterion in the year-end competition assessment of schools and individual managers.

According to the leader of the City Department of Education and Training, Clause 4, Article 10 of Circular No. 55/2011 of the Ministry of Education and Training stipulates: " The Parents' Representative Board (PA) is not allowed to collect donations from students or their families:

a) Donations are not voluntary.

b) Donations that do not directly serve the activities of the Parents' Representative Board: Protecting school facilities, ensuring school security; supervising students' vehicles; cleaning classrooms and schools; rewarding school administrators, teachers and staff; purchasing machinery, equipment and teaching aids for schools, classrooms or for administrators, teachers and staff; supporting management work, organizing teaching and educational activities; repairing, upgrading and constructing new school facilities.

However, according to the Department of Education and Training, in some educational institutions, the Parents' Representative Committee has used its name to mobilize contributions outside of the regulations, causing parents to be upset. The Department of Education and Training has quickly grasped the feedback and issued timely instructions to rectify and prevent the above situation.

According to Circular No. 55, the Parents' Representative Board is organized every school year to coordinate with the school in carrying out educational activities. Therefore, the Parents' Representative Board's use of the name of mobilizing parents to contribute money that does not directly serve the activities of the board is against the regulations.

The Department of Education and Training requested the People's Committee of Ben Thanh Ward (HCMC) to organize a review of the responsibility of the Principal of Le Ngoc Han Primary School.

The Department of Education and Training of the City has issued many documents providing detailed instructions on fundraising according to Circular No. 16 of the Ministry of Education and Training, specifically and most recently, Document No. 2705 on additional instructions for implementing Circular No. 55 and Circular No. 16. In particular, the Department of Education and Training specifically prohibits taking advantage of the name of the Parents' Representative Board to collect revenues outside of regulations; not taking advantage of sponsorship to force parents to contribute and not considering fundraising as a condition for providing education and training services; not regulating the average sponsorship level, not regulating the minimum sponsorship level. Publicly and transparently disclose all revenues and expenditures in detail on the school's notice board, website or parent group. Resolutely require schools to guide the Parents' Representative Board to operate in accordance with the charter, not to organize the collection and expenditure of items not included in the list of state regulations.

Reviewing the responsibility of a principal

According to the City Department of Education and Training, the department recently received information from parents of students at Le Ngoc Han Primary School (Ben Thanh Ward) reflecting on the collection of fees from the Parents' Representative Board of each class being inappropriate and not in accordance with regulations.

The Department has worked with the leaders of the Department of Culture and Society of Ben Thanh Ward People's Committee and the Board of Directors of Le Ngoc Han Primary School to verify the content of the above incident.

Through the principal's report, the Board of Representatives of class 5/2 of Le Ngoc Han Primary School has proposed a table of expected revenue and expenditure for the year of the Parents' Representative Board, including the content of "equipping and installing network systems for the class". Letting the Parents' Representative Board of the class propose expected revenue contents that are not in accordance with the regulations in Point b, Clause 4, Article 10, Circular No. 55 of the Ministry of Education and Training as above has caused outrage among parents of students of the school and created negative public opinion about the education and training sector related to the management and operation responsibilities of the school principal.

To enhance the sense of responsibility of educational management staff, the Department of Education and Training requested the People's Committee of Ben Thanh Ward to organize a review of the responsibility of the Principal of Le Ngoc Han Primary School in the management work to prevent negative public opinion from affecting the reputation of the school and the industry. At the same time, it requested the leaders of the People's Committee of Ben Thanh Ward to have a plan for a general review and take measures to promptly handle and rectify all educational facilities in the entire ward to rectify violations (if any) and take measures to avoid similar situations.
