The Ministry of Home Affairs said it has completed the draft Decree regulating the number of Vice Chairmen of the People's Committee (PC); the number and structure of members of the PC; the order and procedures for approving the results of the People's Council's election, dismissal, and removal of the Chairman and Vice Chairmen of the PC; the order and procedures for transferring and removing the Chairman and Vice Chairmen of the PC and delegating the authority of the Chairmen of the PC at all levels.

According to the Ministry of Home Affairs , after the reorganization, the whole country now has 34 provincial-level administrative units (a reduction of 29 units) and 3,321 commune-level administrative units (a reduction of 6,714 units).

Pursuant to Resolution No. 203/2025/QH15 on amending and supplementing a number of articles of the Constitution, the Prime Minister has issued decisions appointing the positions of Chairman and Vice Chairman of the Provincial People's Committee; the Standing Committee of the Provincial People's Council has issued resolutions appointing the positions of Chairman and Vice Chairman of the Commune People's Committee and members of the Provincial People's Committee; the Standing Committee of the Commune People's Council has also appointed the positions of members of the Commune People's Committee.

Up to now, the arrangement of administrative units has been completed; the appointment of personnel has ensured that the two-level local government apparatus operates stably, smoothly, and without interruption in local management and administration.

However, to meet the practical requirements of personnel work in the period of operating the 2-level local government model, it is necessary to have specific and unified regulations on the organization, apparatus, number of Vice Chairmen of the People's Committee, number and structure of members of the People's Committees at all levels, especially the process and procedures for approving, transferring, dismissing and delegating the authority of the Chairman and Vice Chairmen of the People's Committees at the provincial and commune levels.

In addition, the Law on Organization of Local Government No. 72/2025/QH15, the Law on Cadres and Civil Servants No. 80/2025/QH15, and other implementing documents have added many new regulations on the organization, structure, authority and personnel procedures of People's Committees at all levels, leading to the regulations in Decree No. 08/2016/ND-CP and the amended and supplemented decrees no longer being suitable, especially the contents related to the organizational model, the number of Vice Chairmen and the personnel work procedures, causing difficulties for localities in implementation.

Therefore, the issuance of a new Decree is necessary to ensure a unified, synchronous and feasible legal basis for the organization, operation and personnel work of local authorities after the administrative unit arrangement; at the same time, creating a favorable legal corridor for localities, contributing to improving the effectiveness and efficiency of management and administration of People's Committees at all levels.

The number of Vice Chairmen of the People's Committee is appropriate to the scale and characteristics of the locality.

According to the draft Decree, the Ministry of Home Affairs proposed that for provinces and centrally run cities that carry out mergers and acquisitions: Ho Chi Minh City will have no more than 8 Vice Chairmen; centrally run cities formed by merging and consolidating 3 units will have no more than 7 Vice Chairmen; and merging 2 units will have no more than 6 Vice Chairmen.

A province formed by merging two provinces, including at least one type I province, or merging three provinces has no more than six Vice Chairmen.

A province formed from two type II and III provinces has no more than five Vice Chairmen.

For provinces and cities that did not merge according to administrative unit classification before the Decree took effect: Type I provinces have no more than 4 Vice Chairmen, type II and III provinces have no more than 33 Vice Chairmen.

Notably, to ensure flexibility and meet the requirements of personnel work, the draft Decree stipulates that in cases where the Politburo and the Secretariat mobilize and rotate cadres to hold the position of Vice Chairman of the Provincial People's Committee, this number is outside the prescribed framework.

For localities with separate Resolutions of the National Assembly providing otherwise, the provisions of that Resolution shall apply.

For the commune level, the draft Decree stipulates that the average number of Vice Chairmen of the People's Committee at the commune level is no more than 2.5 people/administrative unit, calculated for the entire province or city.

Based on the total allocated number, the Chairman of the Provincial People's Committee shall decide the specific number of Vice Chairmen of each commune level in accordance with the population size, area, administrative unit classification, socio-economic conditions and regional characteristics, but not exceeding the total assigned number. For special zones with a permanent population of less than 1,000 people, the Government's separate regulations shall apply.

Regarding the structure of the People's Committee members, the draft stipulates that the composition of the People's Committee members at all levels includes heads of specialized agencies, members in charge of military affairs, members in charge of public security. The number and specific titles are implemented according to the Government's regulations on the organization of specialized agencies under the People's Committees at all levels, ensuring consistency with the 2-level local government organization model and the requirements for streamlining, compactness, and efficiency.

Simplify procedures and apply technology in human resources work

The Ministry of Home Affairs also proposed a process for approving, dismissing and removing the Chairman and Vice Chairman of the People's Committee in the direction of simplifying administrative procedures, clarifying authority, reducing processes; clarifying the components of the dossier, ensuring consistency between Party regulations and State laws.

Accordingly, after the People's Council elects or decides to dismiss or remove the Chairman or Vice Chairman of the People's Committee, the Standing Committee of the People's Council is responsible for completing the dossier and sending it to the competent authority for approval. The Ministry of Home Affairs reviews the dossier for provincial-level personnel, the Department of Home Affairs reviews the dossier for commune-level personnel. The Prime Minister approves the results of the election, dismissal, or removal of the Chairman or Vice Chairman of the People's Committee at the provincial level. The Chairman of the People's Committee at the provincial level approves the dossier for commune-level personnel.

At the same time, to enhance the application of information technology in processing records and simplify administrative procedures, the draft supplements regulations on using existing record components on the national database of cadres and civil servants to replace paper records.

In addition, the draft Decree stipulates the cases of transferring and removing the Chairman and Vice Chairman of the People's Committee and supplements regulations on the process and documents for transferring the authority of the Chairman and Vice Chairman of the People's Committee to suit the practical situation of the locality and ensure proactiveness, timeliness and continuity in the activities of local authorities.
