Proposed fines for violations of ID card usage, everyone needs to know

The Ministry of Public Security is drafting a Decree amending and supplementing a number of articles of Decree 144/2021/ND-CP regulating administrative sanctions for violations in the fields of security, order, and social safety; prevention and control of social evils; fire prevention and fighting; rescue; and prevention and control of domestic violence.

This includes proposing to amend regulations on fines for violations in granting, managing and using citizen identification cards, identity cards or electronic identification cards in Article 10 of Decree 144/2021/ND-CP.

Specifically, the fines for violations of the use of ID cards and electronic ID cards proposed by the Ministry of Public Security are as follows:

Firstly, a warning or a fine from VND 300,000 to VND 500,000 shall be imposed for one of the following acts:

Failure to present a citizen identification card, identity card or electronic identity card, identity certificate or 9-digit identity card information confirmation paper with personal identification number, cancelled personal identification number confirmation paper with re-established personal identification number when requested for inspection by a competent authority;

Failure to comply with legal regulations on granting, changing, re-granting identity cards, identity certificates; granting electronic identity cards;

Failure to return the citizen identification card, identification card or identification certificate to the agency executing the temporary detention order, the agency executing the prison sentence, the agency executing the decision to send to a reformatory school, compulsory education facility, or compulsory drug rehabilitation facility.

Second, a fine of between VND 1,000,000 and VND 2,000,000 shall be imposed for one of the following acts:

Appropriation and use of citizen identification cards, identity cards, electronic identification cards, identity certificates, 9-digit identity card information confirmation papers with personal identification numbers, cancelled personal identification number confirmation papers with re-established personal identification numbers;

Erasing, modifying or otherwise distorting the content of a citizen identification card, identity card, identity certificate, 9-digit identity card information confirmation paper with personal identification number, cancelled personal identification number confirmation paper with re-established personal identification number;

Destroying or intentionally damaging citizen identification cards, identity cards, identity certificates, 9-digit identity card information confirmation papers with personal identification numbers, canceled personal identification number confirmation papers with re-established personal identification numbers;

Failure to return the citizen identification card or identity card to the competent authority when the Vietnamese nationality is revoked, revoked, or the decision to grant Vietnamese nationality is revoked; failure to return the identity certificate when a person of Vietnamese origin whose nationality has not been determined is granted Vietnamese nationality or confirmed to have Vietnamese nationality or confirmed to have foreign nationality.

Third, a fine of between VND 2,000,000 and VND 4,000,000 shall be imposed for one of the following acts:

Forging, using fake papers, documents, data to obtain a citizen identification card, identity card, electronic identity card, identity certificate, 9-digit identity card information confirmation paper with personal identification number, canceled personal identification number confirmation paper with re-established personal identification number;

Providing false information and documents to obtain a citizen identification card, identity card, electronic identity card, identity certificate; 9-digit identity card information confirmation paper with personal identification number, canceled personal identification number confirmation paper with re-established personal identification number.

Fourth, a fine of between VND 4,000,000 and VND 6,000,000 shall be imposed for one of the following acts:

Forging citizen identification cards, identity cards, electronic identification cards, identity certificates, 9-digit identity card information confirmation papers with personal identification numbers, cancelled personal identification number confirmation papers with re-established personal identification numbers but not being prosecuted for criminal liability;

Using fake citizen identification cards, fake identity cards, fake electronic identity cards, fake identity certificates, 9-digit identity card information confirmation papers with personal identification numbers, canceled personal identification number confirmation papers with fake re-established personal identification numbers;

Mortgage, pledge, receive pledge of citizen identification card, identity card or identity certificate;

Buy, sell, rent, lease citizen identification cards, identity cards or identity certificates;

Borrowing or lending a citizen identification card, identity card or identity certificate to commit an act against the provisions of law.

Note, the above fine is the fine applied to administrative violations of individuals. For organizations committing the same violation, the fine is twice the fine applied to individuals.
