Proposal to amend the Regulations on building, managing and implementing the Vietnam National Brand Program

(Chinhphu.vn) - The Ministry of Industry and Trade is drafting a Decision of the Prime Minister amending and supplementing a number of articles of the Regulations on building, managing and implementing the Vietnam National Brand Program issued together with Decision No. 30/2019/QD-TTG dated October 8, 2019 of the Prime Minister.

The Ministry of Industry and Trade said that after nearly six years of implementing Decision No. 30/2019/QD-TTg, the Vietnam National Brand Program has achieved many positive results, contributing to affirming the reputation of Vietnamese goods and services in domestic and foreign markets. The business community's awareness of the importance of brands has been significantly improved; the number of enterprises with products achieving National Brand status has increased continuously through the selection periods (From the initial 30 enterprises with 50 products recognized in 2008, by 2024, 190 enterprises with 359 products were honored). According to the Brand Finance Organization's report in 2024, the value of Vietnam's national brand reached 519.62 billion USD (up 2.5% compared to 2023), ranking 32nd out of 193 globally assessed economies, affirming Vietnam's reputation as well as the effectiveness of brand development policies. These results show that the National Brand Program has actively contributed to promoting the country's image and enhancing the competitiveness of Vietnamese products and enterprises in the international market.

The Ministry of Industry and Trade also said that, through review, a number of regulations in Decision No. 30/2019/QD-TTg need to be reduced and simplified administrative procedures, specifically as follows:

Some regulations on dossier components in Decision No. 30/2019/QD-TTg create a burden of compliance costs for businesses when carrying out administrative procedures:

Clause 2, Article 8 of the current Regulations stipulates that enterprises must submit 03 identical sets of documents to register for selection of products to achieve the Vietnam National Brand.

Clause 3, Article 8 of the Regulation currently stipulates that the dossier consists of 12 types of papers and documents, including some types of papers and documents that the competent authorities can proactively exploit from the shared data sources of other state management agencies.

The regulations on time for handling administrative procedures in Decision No. 30/2019/QD-TTg need to be adjusted to comply with the Party and State's policy of reducing the time for handling administrative procedures:

The proposal to reduce the time for handling administrative procedures by 30 days (the deadline for returning results until September 30 is shortened to August 30 of the year of selection) helps businesses with products achieving the Vietnam national brand to promptly use this title to carry out communication and promotion work, contributing to improving production and business efficiency, and increasing brand value.

Modify some content

In the draft, the Ministry of Industry and Trade proposes to amend and supplement Clause 2, Article 8 of the Regulations issued together with Decision No. 30/2019/QD-TTg in the direction that enterprises submit 01 set of documents to register for selection of products that meet the Vietnam National Brand. Specifically, according to the draft: Enterprises submit 01 set of documents to register for selection of products that meet the Vietnam National Brand before March 31 of the selection year to the Ministry of Industry and Trade in one of the following ways: Via postal service; directly at the headquarters of the Ministry of Industry and Trade; the administrative procedure settlement information system of the Ministry of Industry and Trade.

The draft proposes to amend and supplement Clause 3, Article 8 of the Regulations issued together with Decision No. 30/2019/QD-TTg in the direction of reducing some components in the dossier for registration of products to be selected to achieve the Vietnam National Brand.

Accordingly, the application for product selection to achieve the Vietnam National Brand includes the following documents and papers:

1- Register to participate in the selection of products that achieve the Vietnam National Brand according to Form No. 01 of the Appendix issued with these Regulations;

2- Uncertified copy of the enterprise's audited financial statements for 2 consecutive years prior to the selection year;

3- A copy of the documents on the quality of the registered product that are still valid according to the provisions of law;

4- A copy without certification of the valid intellectual property protection certificate of the registered product, issued by the competent authority;

5- Uncertified copies of management system certificates, productivity improvement tools, basic and specific quality by industry and field (ISO9001, ISO 14001, ISO 22000, ISO/IEC 17025, SA 8000, ISO 45001, HACCP, GMP, VietGAP, GlobalG.AP and other management systems);

6- Uncertified copies of certificates of awards for quality and brand reputation (if any).

In addition, the draft proposes to amend and supplement Clause 5, Article 8 of the Regulations issued together with Decision No. 30/2019/QD-TTg in the direction of reducing the time to handle administrative procedures.

Replace Form No. 01 in the Appendix issued with Decision No. 30/2019/QD-TTg dated October 8, 2019 of the Prime Minister .
