Tree cutting without notice, company must pay 12 million VND in compensation

Workers from a company hired to trim trees in Da Nang cut down a resident's rosewood tree without prior notice and must pay 12 million VND in compensation.

On November 29, the police of Hoa Khanh Nam ward invited representatives of Phuoc Ly Xanh Co., Ltd. and the homeowner at 56 Nguyen Khac Nhu to work. The company agreed to plant other trees to replace them and compensate the homeowner 12 million VND for cutting down the rosewood tree without prior notice.

Phuoc Ly Xanh Co., Ltd. signed a contract with the government to trim trees to prevent natural disasters around roads less than 7.5 m wide in three wards, including Hoa Khanh Nam. On the afternoon of November 27, some workers saw an 8 m high sưa tree showing signs of drying and losing its leaves in front of house number 56 Nguyen Khac Nhu, so they asked to cut it down. The company's director, Mr. Pham Phu Dung, agreed to cut the tree down and transport it to the staging area.

At the time of cutting down the tree, the owner was not at home and had not been notified in advance, so he thought it was stolen and reported it to the police. He said the tree was a red sưa tree, bought 8 years ago for 5 million VND.

After learning about the tree felling by workers but not contacting the neighborhood group or homeowner, on the afternoon of November 28, director Pham Phu Dung contacted the homeowner to request a replacement tree be planted, but was not approved.

At the police station, a representative of Phuoc Ly Xanh Company admitted that the tree felling was not done according to the correct procedure. "If the homeowner is not at home, the tree felling must be stopped. However, because the tree trimming was being done to prevent floods and storms and the trees were infected with pests, the workers rushed to finish the work on time, leading to the unexpected incident," Mr. Dung explained.
