Mr. Nguyen Tam Thinh - Chairman of the Board of Directors of Trung Nam Construction Investment Joint Stock Company (Trung Nam Group) - has just signed a document to send to the Central Party Office and the Government Office regarding the biggest problem of the Project to Solve Flooding Due to Tides in Ho Chi Minh City Area Taking into Account Climate Change Factors (Phase 1).

This 10,000 billion VND flood prevention project, invested by Trung Nam Group, started on June 26, 2016 but has yet to reach the finish line.

According to Trung Nam Group, the project was more than 90% completed in 2020, then paused so that the Ho Chi Minh City People's Committee could petition the Government to remove legal obstacles.

Then, the Government issued Resolution 40/NQ-CP dated April 1, 2021. According to the Resolution, the inappropriate payment method in the BT contract of the project is mentioned in Article 1 and the directive clearly states: "This issue is the responsibility of the Ho Chi Minh City People's Committee and related organizations and individuals".

Trung Nam Group said that since the Government issued Resolution 40, although the investor has reported many times, the Ho Chi Minh City People's Committee has not yet adjusted the BT contract to realize the Government's direction. In recent reports, the city is still petitioning the Government with proposed contents that are not consistent with the content of Resolution 40.

"The payment method of the project has been specifically directed in Notice No. 285/TB-CP dated August 20, 2015 of the Government Standing Committee as follows: "Applying the form of construction - transfer (BT) payment by land fund, in case the value of the land fund payment is less than the value of the BT project, the People's Committee of Ho Chi Minh City will be paid by the city budget for the difference.

This is the first and biggest problem that needs to be resolved to unblock the project, so that other related legal procedures can continue to be implemented" - stated the document of Trung Nam Group.

Therefore, investors hope to receive support from central agencies so that the project can be re-implemented, completed and put into operation soon.

At the same time, the enterprise requested that Ho Chi Minh City pay attention and remove obstacles for the project in accordance with the contents of Resolution 40, Notice No. 285/TB-CP and current legal regulations.

Previously, in mid-December 2024, the Government Office issued a document conveying the Prime Minister 's opinion on focusing on removing obstacles for the above-mentioned flood prevention project.

In particular, the Prime Minister requested the Minister of Planning and Investment, the Governor of the State Bank and the Chairman of the Ho Chi Minh City People's Committee to urgently and seriously implement the instructions in Document No. 9050/VPCP-NN dated December 9.

The Prime Minister also requested the Chairman of the Ho Chi Minh City People's Committee to proactively work with the Ministry of Planning and Investment and relevant agencies to urgently propose solutions to handle the project's problems, and report before December 20.

In addition, the Prime Minister requested the Standing Committee of the Ho Chi Minh City Party Committee to direct and urge the City People's Committee and relevant agencies to focus on thoroughly resolving the project's problems.
