The Government has just issued Decree No. 248 regulating the salary, remuneration and bonus regimes of direct owners' representatives, representatives of State capital and controllers in State-owned enterprises.
The Decree takes effect from September 15. Accordingly, the maximum salary and remuneration levels are prescribed according to the positions of chairman, member of the board of directors, member of the board of members, head of the supervisory board, and controller, calculated on a monthly average and linked to annual production and business targets.
Basic salary is applied from 30 to 80 million VND/month depending on the positions and scale of the business.

Decree 248 stipulates that the maximum salary of board members and full-time controllers is determined based on the above basic salary and the enterprise's realized profit.
Specifically, if the enterprise has profit and the realized profit is not lower than the plan, the maximum salary is equal to 2 times the basic salary. If the realized profit exceeds the plan, the principle is followed: 1% of profit exceeding the plan, an additional 2% of the salary is calculated but not more than 20% of the salary calculated on the basis of 2 times the basic salary.
In case the realized profit is lower than the plan, the maximum salary is calculated by multiplying 80% by 2 times the basic salary and multiplying by the ratio of realized profit to planned profit, but not lower than 80% of the basic salary.
For unprofitable enterprises, the maximum salary is 70% of the basic salary. For loss-making or loss-making enterprises, the maximum salary is determined to be 50% of the basic salary.
In particular, enterprises with profits 2-4 times higher than the minimum profit target as prescribed, leaders can receive a maximum salary equal to 2.5 to 4 times the basic salary. Thus, the position of Chairman of the Board of Directors or Chairman of the Board of Members of Group 1 enterprises can receive a maximum salary of about 320 million VND/month.
In addition, the bonuses of board members and controllers are determined in the bonus fund deducted from the reward and welfare fund according to the provisions of the Law on Management and Investment of State Capital in Enterprises, the Government's regulations on management and investment of State capital in enterprises and the enterprise's bonus regulations.
The maximum annual specific bonus shall not exceed the number of months of the enterprise's salary deducted to establish the reward and welfare fund multiplied by the allocation ratio between the reward fund and the welfare fund according to the enterprise's regulations or rules and multiplied by the average monthly salary.
