Create connection and communication between 3 laws

Discussing at Group 9 (including the National Assembly delegations of Hung Yen and Hai Phong provinces), Vice Chairman of the National Assembly Nguyen Khac Dinh stated that in 2013, the 8th Conference of the 11th Central Committee issued Resolution No. 29-NQ/TW on fundamental and comprehensive innovation in education and training. This is a very breakthrough resolution in the field of education and training and has been implemented for many years. In the 12th session, the Central Committee issued Resolution No. 19-NQ/TW on the arrangement of public service units, including schools and schools in the field of vocational education. Recently, the Central Committee has summarized, reviewed and found it necessary to adjust and amend some contents of these 2 resolutions. Therefore, amending and supplementing the laws on education to promptly institutionalize the contents that need to be adjusted in the 2 resolutions.

The Vice Chairman of the National Assembly also said that the amendment of these laws is also to implement the policy of Resolution No. 18-NQ/TW on organizational arrangement; the policy on promoting decentralization, delegation of power, and local responsibility. At the same time, to create connectivity and synchronization in the management of vocational education and higher education.

Emphasizing that learning is not only for the purpose of working or finding a career, but also for cultivating knowledge, understanding and setting an example for the next generation, the Vice Chairman of the National Assembly stated that the goal of amending these laws is also to create connections, interconnectivity, and opportunities for people to learn throughout their lives. Therefore, the provisions in the 3 draft laws must be consistent with each other as well as consistent with the draft Resolution of the National Assembly on a number of specific and outstanding mechanisms and policies to make breakthroughs in education and training development.

Encouraging co-owned vocational school business models

Commenting on the draft Law on Vocational Education (amended), National Assembly Deputy Nguyen Thi Viet Nga (Hai Phong) agreed with the specific regulations added in Chapter VI on the role, rights and responsibilities of enterprises in vocational education.

Delegates recognized that this is an important step to institutionalize the major policy of the Party and State on socialization and linking training with the labor market; at the same time, concretizing the spirit of Resolution No. 57-NQ/TW and Resolution No. 68-NQ/TW of the Politburo.

“In the context of the economy strongly transforming towards green, digital and creative, clearly legalizing the role of enterprises in vocational education is a prerequisite to improve the quality of human resources, especially technical human resources and vocational skills - which are the weaknesses and bottlenecks of the current Vietnamese labor market.

The Draft Law has clear, strict and progressive regulations on the roles, rights and responsibilities of enterprises," delegate Nguyen Thi Viet Nga emphasized.

Regarding the responsibilities of enterprises, Article 33 of the draft Law specifically stipulates that enterprises must arrange experts and engineers to participate in training, create conditions for employees to study and improve their skills, coordinate with vocational training institutions, pay salaries and expenses for interns and participate in developing programs and textbooks for vocational skills standards.

According to delegate Nguyen Thi Viet Nga, these strict regulations in the draft Law have turned enterprises into proactive links in the human resource training value chain instead of considering enterprises as simply output recipients as they are now.

Delegates also highly appreciated the comprehensiveness and balance of this group of regulations, which both ensure rights and create motivation for businesses but also bind responsibilities to ensure the quality and sustainability of the vocational training system.

However, delegate Nguyen Thi Viet Nga stated that in reality, the actual relationship between schools and businesses is still very loose, formal and lacking in depth.

Therefore, it is necessary to supplement the 3-party contract mechanism between the State, vocational training institutions and enterprises to clearly define the rights, obligations and responsibilities of each party, especially in sharing training costs, evaluating results and recruiting after training. In addition, there should be clearer regulations on financial and tax incentives for enterprises participating in vocational training.

Regarding FDI enterprises, delegate Nguyen Thi Viet Nga said that a minimum rate of vocational training or skill transfer should be required for Vietnamese workers. This is both a measure to increase national strength and a tool to force FDI enterprises to fulfill their social responsibilities. At the same time, it is necessary to encourage the model of jointly owned vocational school enterprises. Accordingly, enterprises that contribute capital to invest in facilities have the right to co-manage the training program and use students as reserve human resources.

Also interested in Article 33, National Assembly Deputy Nguyen Dai Thang (Hung Yen) stated that Clause 1 of Article 33 stipulates that enterprises are responsible for arranging experts and technical staff to participate in vocational training, accepting lecturers, teachers and students to practice at enterprises, organizing vocational training for employees or contributing funds for vocational training according to Government regulations.

“This regulation is not really clear, it is still general. Are experts and technical staff understood as experts decided by competent State agencies or experts by enterprises and what are the selection criteria?”, delegates wondered.

To perfect this regulation, delegate Nguyen Dai Thang suggested replacing the phrase "experts and technical staff participating in vocational training" with "people with specialized expertise and skilled techniques participating in vocational training" to ensure specificity.
