To determine areas requiring urgent dredging, the regional maritime port authority will preside over and coordinate with the public navigation channel management unit to conduct a survey, make a preliminary assessment of the level of emergency, and report to the Vietnam Maritime Administration to carry out emergency dredging of the public navigation channel.

In the draft, the Vietnam Maritime Administration and the Vietnam Inland Waterways Administration appraise and evaluate the level of sedimentation, filling, landslides, and silting on the channel that cause congestion, hinder maritime traffic activities, inland waterway traffic, and pose safety risks, and report to the Ministry of Transport to decide on emergency dredging (Illustration photo).

The regional inland waterway management agency shall preside over and coordinate with the inland waterway management and maintenance unit to survey and make a preliminary assessment of the emergency level and report to the Vietnam Inland Waterways Administration to urgently dredge the national inland waterway channel.

The report content must include the purpose of dredging, dredging location, person assigned to manage and perform emergency dredging of the project, time of dredging of the project, area and location for receiving dredged materials approved by competent authority or area and location for temporary gathering and receiving of dredged materials.

In addition, there must be an estimate of the costs and resources for implementation and other relevant necessary requirements.

Based on the report, the Vietnam Maritime Administration and the Vietnam Inland Waterways Administration shall assess and evaluate the level of sedimentation, filling, landslides, and sedimentation on the channel causing congestion, obstruction to maritime traffic, inland waterway traffic, and the risk of loss of maritime and waterway safety or serious impact on maritime and waterway activities, and report to the Ministry of Transport for decision on emergency dredging.

The draft clearly states that the Vietnam Maritime Administration and the Vietnam Inland Waterways Administration will be assigned to manage and implement emergency dredging of public shipping channels and national inland waterways.

These two agencies are authorized to decide on all work in emergency dredging activities, including assigning organizations and individuals to carry out survey, design and dredging construction work and other necessary work to serve emergency dredging works; deciding on the order of survey, design and dredging construction; deciding on dredging construction supervision and acceptance of works that meet the requirements of the emergency dredging order.

Based on the approved emergency dredging order, a capable and experienced contractor will be selected and appointed to immediately carry out the emergency dredging project packages according to the shortened process.

At the same time, direct relevant units to organize surveys and hand over the site (including dredging site and dredged material dumping location) to the construction contractor to organize the implementation of the project.

In case of using temporary areas and locations for gathering and receiving dredged materials, during the construction process, the Vietnam Maritime Administration and the Vietnam Inland Waterways Administration shall coordinate with relevant agencies and units to carry out environmental procedures according to regulations to obtain approval from competent authorities for the official areas and locations for receiving dredged materials for the emergency dredging project of public waterways and national inland waterways and continue dredging and transporting to the official location for dumping dredged materials.

After completing the emergency dredging construction, these two agencies are responsible for organizing the preparation of project completion records and synthesizing and submitting them to the Ministry of Transport for approval to adjust and supplement the maritime construction maintenance plan with the task of urgently dredging public maritime channels and national inland waterways.

Based on the approved maritime maintenance plan, the Ministry of Transport assigned to adjust and supplement the state budget expenditure estimate to pay for the urgent dredging task of public maritime channels and national inland waterway channels.
