Strengthening state management of karaoke and discotheque business activities

The Department of Grassroots Culture has sent a document to the Departments of Culture, Sports and Tourism and the Departments of Culture and Sports of provinces and cities on continuing to strengthen state management of karaoke and discotheque business activities.

Recently, the Ministry of Culture, Sports and Tourism has organized an assessment of the implementation of Decree No. 54/2019/ND-CP of the Government regulating the business of karaoke services and discotheque services. After synthesizing the implementation situation of state management and recommendations of enterprises, in order to strengthen state management of karaoke and discotheque services, based on the actual situation, localities need to implement a number of contents as follows:

For the State management tasks under the authority and functions of the Department: Guide and disseminate the process of granting Business Eligibility Certificates to enterprises and business households providing karaoke and discotheque services; Strictly review and control the business conditions prescribed in Decree No. 54/2019/ND-CP and other relevant legal documents for dossiers requesting the issuance of business eligibility certificates for karaoke and discotheque services; In case of determining signs of violations according to current regulations, propose the competent authority to revoke the business registration certificate; proceed to revoke the Business Eligibility Certificate for karaoke and discotheque services according to the provisions of law.

Ensuring security and order and fire prevention and fighting

At the same time, advise the People's Committee of the province and city to direct relevant Departments and branches to implement a number of contents such as:

Regarding the work of ensuring security and order and fire prevention and fighting: Strengthen state management measures on fire prevention and fighting at karaoke service establishments and dance halls; Strictly implement the issuance of certificates of eligibility for security and order for karaoke service establishments and dance halls according to the provisions of law; Direct functional forces to strengthen propaganda, guidance, and fire prevention and fighting drills; develop a program to coordinate surveys, inspections, and comprehensive reviews of establishments at risk of fire and explosion, especially karaoke service establishments; Proactively and promptly answer and provide specific and detailed instructions on regulations and solutions for agencies, organizations, businesses, and people to overcome violations; resolutely suspend or terminate operations of establishments that do not ensure fire prevention and fighting safety according to regulations.

Regarding the application of technical standards and regulations on fire prevention and fighting: Disseminate and popularize to investors and heads of establishments legal knowledge, standards and technical regulations on fire prevention and fighting (standard QCVN 06:2022/BXD dated November 30, 2022 of the Ministry of Construction on fire safety for houses and buildings); Instruct karaoke service establishments and discotheques when constructing new or renovating and repairing within the scope of regulation to comply with standard QCVN 06:2022/BXD and related technical standards and regulations; Review and propose to remove difficulties and obstacles in the application of technical standards and regulations for construction investment activities according to each subject and type of establishment that still exists and is entangled on the principle of ensuring fire and explosion safety requirements.

It is necessary to continue to strengthen the inspection and examination of compliance with specialized legal regulations, especially the inter-sectoral coordination with relevant units to inspect and examine compliance with legal regulations on security and order; crime prevention and control; fire and explosion prevention and control at karaoke and discotheque business establishments. Handle violations according to authority for organizations and individuals providing these services and notify the results of handling to relevant agencies. Thereby, report the results of implementing the above tasks to the Department of Grassroots Culture for synthesis and reporting to the Ministry's leaders according to regulations.
