Continue to comment on draft laws submitted to the National Assembly

On the afternoon of October 22, under the chairmanship of Vice Chairman of the National Assembly Nguyen Duc Hai, the provincial National Assembly delegation continued to discuss in groups and give opinions on draft laws amending and supplementing a number of articles of the Law on Education, draft Law on Higher Education (amended), and draft Law on Vocational Education (amended).

Commenting on the Draft Law on Higher Education (amended), delegate Trang A Duong proposed to add a special mechanism for admission in the form of nomination to create a source of ethnic minority cadres to serve particularly difficult areas, institutionalizing the Party's policy. He requested the drafting agency to review and ensure the consistency and synchronization of the provisions in the draft Law with the Law on Science, Technology and Innovation 2025, while demonstrating the specificity of the higher education sector. Regarding the Draft Law on Vocational Education (amended), delegate Trang A Duong requested the drafting agency to review to ensure compatibility and consistency with other relevant laws being amended such as the Law on Education, the Law on Teachers, the Law on Land, etc.

At the same time, it is proposed to clearly add businesses and learners to the subjects of application of the Law. Institutions participating in vocational education activities (Article 7): The provisions on "centers participating in other vocational education activities" are still general, it is proposed to specify that this center implements the elementary training program. Finance of public vocational education institutions (Article 35): Agree with the empowerment of institutions to decide on capital mobilization and use. However, it is proposed to add regulations to strengthen the monitoring mechanism, publicity and transparency of capital mobilization and use (such as requiring annual financial reports) to limit negativity and improve efficiency.

Comrade Ma Thi Thuy, Deputy Head of the National Assembly Delegation working full-time in the province, commented: Voters agree with the State's policy of providing a unified set of textbooks nationwide to ensure educational equity, especially in disadvantaged areas. However, it is necessary to clarify whether this set of textbooks is mandatory or free while other sets are still selected. It is recommended that the Government provide specific guidance on the mechanism for selecting and using textbooks to avoid confusion. The free textbook policy is humane, but it is necessary to clarify the mechanism for providing, managing, and encouraging shared textbook libraries to avoid waste.

Regarding the compilation and appraisal of textbooks, it is necessary to ensure the independence and transparency of the National Appraisal Council, have clear standards for members (priority is given to experts, experienced teachers, and those with no interests related to the publisher), and publicize the appraisal results, and widely solicit opinions from the grassroots. It is reasonable to delegate authority to the provincial People's Committee to approve the local textbooks, but it is necessary to: clearly define the content limits (only specific to the locality, not duplicate the national textbooks), the Ministry of Education and Training issues a unified framework of guidelines on the structure, and strengthen periodic inspections to avoid historical and cultural errors. Textbooks and local textbooks should be presented in many forms (printed books, Braille, electronic) and it is recommended that there be a mechanism to support digital equipment for disadvantaged areas.

According to Deputy Head of the National Assembly Delegation of the province, Ma Thi Thuy, she is still concerned that granting a certificate of completion to those who do not take the exam or fail the exam may cause social misunderstanding and lack a clear legal basis in recruitment/employment. The role, form and authority of organizing the national high school exam have not been clearly defined. The legal value of the "certificate of completion of general education program" needs to be clarified (can it be used for vocational training or secondary school or not?).

Accordingly, comrade Ma Thi Thuy proposed that it is necessary to clearly define the legal value of the certificate (used for vocational training, but not to replace the graduation certificate); add detailed instructions on organizing the graduation exam; and increase publicity and transparency in granting degrees/certificates using identification codes and electronic records.

Delegate Vuong Thi Huong commented on the draft Law on Higher Education (amended) focusing on institutionalizing Resolution No. 72-NQ/TW on a number of breakthrough solutions, strengthening the protection, care and improvement of people's health, and proposing to clearly define the management authority for specialized specialized training in the health sector for the Ministry of Health.

The delegates proposed to revise the provisions assigning the Ministry of Health: the authority to manage specialized specialized training at postgraduate level in the health sector (Article 6); Promulgate specialized training program standards, guide the development, review, evaluation, and supervision of the implementation of standards (Article 22); Promulgate the List of specialized training statistics; prescribe the process of developing, evaluating, and promulgating specialized training programs; the process of approving, suspending, and terminating the implementation of specialized training programs (Article 23); Approve training programs for specialized training programs in the health sector (Article 24); Promulgate regulations on enrollment for specialized training (Article 25); Promulgate regulations on specialized training (Article 26).

The delegate proposed to amend Clause 3, Article 1 of the Draft Law amending and supplementing a number of articles of the Law on Education in the direction of: "The Government shall specify the management of diplomas and certificates of the national education system; equivalent diplomas of a number of specific specialized training sectors" instead of assigning the Ministry of Education and Training to regulate as in the draft Law, in order to ensure consistency and synchronization in the management of diplomas and certificates nationwide.
