Need a mechanism to remove bottlenecks
The Draft Resolution of the City People's Council stipulating a number of investment policies and support for the implementation of social housing construction investment projects in the city has detailed a number of articles, clauses and points stipulated in the Capital Law No. 39/2024/QH15 and the Housing Law No. 27/2023/QH15.

In particular, the subjects of application are investors of social housing construction investment projects invested by Trade Union financial resources. Investors of social housing construction investment projects not using capital sources specified in Clause 1, Article 85 of the Housing Law. Investors of commercial housing construction investment projects directly invest in social housing construction within the scope of commercial housing projects for the land area specified in Clause 2, Clause 3, Article 83 of the Housing Law directly invested in construction by the investor. Other state agencies, organizations and individuals related to social housing construction investment activities in Hanoi city specified in Article 1 of this Resolution.
The Prime Minister has approved the project "Investing in the construction of at least one million social housing apartments for low-income earners and industrial park workers in the 2021-2030 period", in which Hanoi is assigned the target of developing 56,200 apartments, including: 18,700 apartments in the 2021-2025 period, 37,500 apartments in the 2026-2030 period. Hanoi is one of the localities assigned the highest social housing development target in the country.
Therefore, the development and promulgation of the Resolution of the City People's Council "Regulating a number of support policies on investment in the construction of independent social housing in Hanoi" is necessary, consistent with reality, to concretize the policies of the Central Government, the Capital Law, and the Housing Law as mentioned above.
This will create a separate legal basis for the capital to promote the development of social housing in a modern, convenient and synchronous manner with the construction of technical and social infrastructure, contributing to improving the quality of life of the people.

At the conference, Mr. Pham Ngoc Thao, Chairman of the Advisory Council on Legal Democracy - Vietnam Fatherland Front Committee of Hanoi city, suggested that it is necessary to evaluate more clearly the results of implementing the social housing program of Hanoi in recent years, thereby proposing new, more suitable mechanisms and policies to encourage investors and people to participate.
Assessing the necessity and urgency of issuing the Resolution, Associate Professor Dr. Bui Thi An, President of the Hanoi Women Intellectuals Association, Vice Chairman of the Economic Advisory Council, noted the issue of land fund and location. Ms. An said that if the land for project implementation is not convenient in terms of transportation, social infrastructure, and utilities, people will still face difficulties in quality of life. Land policies and project location selection need to be strictly controlled. If only supporting external infrastructure, investors will have to bear internal costs, which can push up selling prices and rental prices or affect housing quality.
Regarding beneficiaries, Ms. An suggested clarifying whether income conditions and criteria for renting and buying social housing are really suitable for young workers or not.

Promoting the role of inspection and strengthening supervision
Concluding the conference, Vice Chairman of the Vietnam Fatherland Front Committee of Hanoi city Pham Anh Tuan received the profound, dedicated and responsible comments of experts and scientists who contributed to the draft Report as well as the draft Resolution of the Hanoi City People's Council.
The issuance of the Resolution is necessary and urgent, an inevitable requirement to concretize the specific mechanism assigned in the 2024 Capital Law on infrastructure investment and the 2023 Housing Law on support mechanisms; it is also a strategic lever to remove bottlenecks, creating a strong driving force for the city to complete the social housing development target. The draft basically ensures a scientific basis, references international experience and practices with clear and specific support policies, creating favorable conditions for reputable investors to participate.
Regarding the support criteria, Mr. Pham Anh Tuan proposed to add detailed regulations on criteria such as location, total investment, and difficulty in site clearance to determine the percentage of preferential support, but not exceeding 50%, to avoid arbitrary application. In addition, it is necessary to publicize the medium-term public investment capital source specifically for independent social housing and the expenditure ratio from land fund revenue of 20-25% of commercial housing projects.
Regarding the post-processing mechanism, Mr. Pham Anh Tuan suggested that the city establish a post-processing mechanism to promptly detect and prevent acts of taking advantage of policies, ensuring the effectiveness of public investment; promoting the role of the People's Inspectorate and the Front Work Committee at the grassroots level to strengthen supervision of the implementation of the Resolution.
