
In order to ensure consistency, transparency and compliance with international practices in the field of civil aviation, the Government has just completed the consolidation and amendment of regulations related to nationality registration, ownership and exploitation. Notably, Decree No. 246/2025/ND-CP, effective from November 1, 2025, has formalized the mechanism for deregistration according to IDERA documents, while promoting the application of electronic administrative procedures in aviation registration activities.
Completing the legal framework on aircraft registration
This consolidated document includes Decree No. 68/2015/ND-CP, along with amendments and supplements from Decree No. 64/2022/ND-CP and Decree No. 246/2025/ND-CP. This is an important legal basis regulating the registration and deregistration of aircraft nationality; registration and deregistration of rights to aircraft; issuance of AEP codes and registration and deregistration of IDERA documents, documents designating persons with the right to request deregistration or export of aircraft.
These regulations apply For agencies, organizations and individuals related to aircraft registration activities in Vietnam, except for public service aircraft such as military , police and customs aircraft (if not used for civil purposes).
Formalizing the deregistration mechanism under IDERA
One of the notable new points of Decree 246/2025/ND-CP is the detailing of the deregistration mechanism according to the IDERA (Irrevocable De-registration and Export Request Authorisation) document, in accordance with the provisions of the Cape Town Convention and Protocol to which Vietnam is a member.
Accordingly, only the person designated in the IDERA document has the right to request the cancellation of nationality registration and export of aircraft. When carrying out this procedure, the dossier must have the written consent of the parties with international interests registered with higher priority, or documents proving that these interests have been processed.
The Civil Aviation Authority of Vietnam (CAAV) will issue a Certificate of Deregistration of Vietnamese Aircraft Nationality and a Certificate of Airworthiness for Export within 5 working days from the date of receipt of a complete and valid dossier.
In order to facilitate organizations and individuals, administrative procedures have been adjusted towards modernization, in accordance with Decree No. 64/2022/ND-CP.
Applicants can submit their applications in person, by post or electronically. Legal documents can be electronic copies of the original or certified copies. In case the application is incomplete, CAAV will issue a written instruction to complete it within 1-2 working days, depending on the type of procedure.
Specific regulations on aircraft nationality registration
An aircraft is registered with Vietnamese nationality if it is owned or operated by a Vietnamese organization or individual (including individuals permanently residing in the country), or is leased without a crew for a period of 24 months or more for operation in Vietnam. At the same time, the aircraft must not have the nationality of any other country or have completed the procedure to deregister its foreign nationality.
The Vietnamese nationality marking of an aircraft includes the Vietnamese national flag and registration code, represented by two letters “VN” followed by a hyphen and a letter and three Arabic numbers.
Specifically: The letter "A" is assigned to jet-engine aircraft; the letter "B" is assigned to turboprop aircraft; the letter "C" is assigned to piston-engine aircraft; and finally the letter "D" is assigned to other aircraft.
The Vietnam Aircraft Register is established on paper or in electronic form, recording all information related to registration, deregistration, ownership, as well as the handling of aircraft collateral. The Civil Aviation Authority of Vietnam will be responsible for notifying the Ministry of National Defense of information on aircraft registration within 15 working days from the date of issuance of the Certificate, serving the management of airspace and flight operations.
According to the new regulations, the Ministry of Construction is the agency responsible for organizing the implementation of the Decree. The Ministry of Finance will issue the collection rates and regulations for managing related fees and charges according to the proposal of the Ministry of Construction.
The consolidation and updating of regulations in Decree No. 68/2015/ND-CP and its amendments, especially Decree 246/2025/ND-CP, marks an important step forward in the process of standardizing and modernizing aircraft registration management in Vietnam, while affirming the Government's commitment to integrating and complying with international standards on civil aviation.
