Speaking with Tuoi Tre Online , representatives of residents who bought houses at the Duong Hong housing project in Binh Hung commune (formerly Binh Chanh district) in Ho Chi Minh City said that they have bought houses for many years but have not yet been granted pink books.
Home buyers are worried
According to these households, due to "impatientness" about the progress of issuing pink books, people discussed with the investor, Duong Hong Construction and Housing Trading Joint Stock Company, and then received a response from the company that it was trying to discuss with the authorities in Ho Chi Minh City to expedite the procedures for issuing pink books to people.
However, what worries people is that they do not know when their house will be granted a certificate of land use rights and home ownership.
Meanwhile, people say that when the pink book is "suspended", households who want to do procedures such as mortgage to have capital for production and business will encounter difficulties.
"Our wish is for businesses and authorities to speed up procedures and resolve any problems. If the house is handed over but 20 years have passed and there is still no pink book, the people who will suffer in the end will be the home buyers," said a resident representative.
The Duong Hong housing project was allocated land by the Ho Chi Minh City People's Committee under Decision No. 6541 in 2004. According to the approved 1/500 detailed planning, the project has a total of 254 houses.
The investor has completed 100% of the technical infrastructure, fulfilled financial obligations and handed over the pink books for 229 apartments. However, the remaining 25 apartments have not yet been granted the pink books, even though these apartments were sold to the people many years ago.
Proposal to soon remove obstacles in granting pink books
According to research, this problem stems from the housing arrangement policy for low-income people issued by the City People's Committee more than 20 years ago.
In 2003, the Ho Chi Minh City People's Committee issued Directive No. 07, requiring housing project investors to reserve 10% of land fund for housing construction, or 20% of housing fund sold according to the principle of capital preservation (with audit) for the State to put into the housing and land fund for key projects of the city.
However, on November 24, 2005, the City People's Committee issued Official Dispatch No. 7623 stipulating "abolishing the regulation of 10% of residential land fund or 20% of housing fund in housing business projects to resell at cost price to the city according to Directive No. 07/2003".
Based on document No. 7623, Duong Hong Company has deployed and traded all commercial housing products according to the approved detailed planning.
Speaking with Tuoi Tre Online , a representative of Duong Hong Company said that after 20 years of investing in infrastructure and business, the investor has sold all housing products at lot 9B4 to customers.
According to this person, although the product has been handed over and people have lived there for many years, they are still stuck and cannot issue pink books for about 10% of the houses in the project. This causes customers to complain and sue, affecting the reputation of the investor.
"The investor hopes that the leaders of Ho Chi Minh City will consider and direct the removal of obstacles in granting certificates to the remaining customers. Create favorable conditions for businesses to operate and do business smoothly," said a representative of Duong Hong Company.
Resolving similar cases
Mr. Le Hoang Chau - Ho Chi Minh City Real Estate Association - said that the project has full legal documents and the enterprise has fulfilled its financial obligations, only 25 houses of the project have not been granted pink books.
According to Mr. Chau, from 2005 until now, all of these customers have not been granted pink books, so they are very disadvantaged and cannot exercise their rights. Recently, the Chairman of the Ho Chi Minh City People's Committee has concluded clearly the criteria for classifying and handling problems of commercial housing projects such as the project of Duong Hong Company, and can completely direct the immediate settlement of granting pink books to home buyers.
In addition, Mr. Chau said that the City People's Committee should consider directing the Department of Agriculture and Environment to guide cases similar to the Duong Hong project to carry out procedures for granting pink books to the remaining customers of these projects.
