329 yards do not comply with planning

These yards are gathering and trading construction materials for people and organizations.

A wharf at the foot of Han bridge (Vinh Bao commune) is not suitable for planning.

According to the Department of Agriculture and Environment of Hai Phong city, up to now, there are 329 yards in the city that are not in accordance with the planning. Of which, the eastern part of the city has 272 yards, the western part has 57 yards.

Currently, these yards are gathering and trading construction materials for the people and organizations. However, most of the organizations and business households are operating without business registration, or their business registration is not in accordance with the name of the organization or business household that is doing business; the management of organizations and business households with yards for gathering and trading construction materials by local authorities is still loose, and legal documents do not comply with legal regulations.

Construction material gathering and trading sites are mainly spontaneous, using and illegally transferring agricultural and aquatic land for leveling, using heavy trucks to travel on and through the dike, causing damage to the dike surface. Gathering sites are often not reinforced, do not implement environmental protection measures; the scale and methods of gathering materials are not suitable, causing labor safety problems, causing environmental pollution...

Most organizations and business households do not have documents proving ownership of the construction; business families use land for purposes other than those in the land lease contracts previously signed with the People's Committees at the commune level...

Hai Phong City has a total of 725 wharves, yards along rivers and inland canals (684 wharves along rivers, 41 wharves along inland canals). Of which, the east of the city has 337 wharves, and the west has 388 wharves.

The Department of Agriculture and Environment requested the City People's Committee to report to the Standing Committee of the City Party Committee to lead and direct Party committees and political systems at all levels to have synchronous solutions in managing the operations of riverside wharves and yards, and inland canals in the area. In which, consider and decide to allow the operation of wharves and yards for gathering construction materials to directly serve key projects and public investment projects of the city to ensure meeting actual needs and complying with legal regulations.

Direct the People's Committees of communes, wards and special zones to implement the following contents: For wharves that are in accordance with the current planning but do not have sufficient legal procedures, focus on guiding and removing difficulties and obstacles to complete all procedures according to the provisions of law, no later than December 31, 2026; from 2027, if the procedures are not fully completed, request to stop operations.

For wharves and yards that are in accordance with the previous phase planning but not in accordance with the current planning: In case there are complete legal procedures to request to stop operations when the project expires or until the State reclaims the land to implement the new planning, depending on which time comes first.

In case there are legal procedures but they are not complete, they must be completed by December 31, 2026 at the latest and operations must stop when the project expires or until the State reclaims the site to implement the new planning.

For the wharves added to the planning, they can continue to operate production and business according to the provisions of law.

For wharves and yards that are not in accordance with the planning at any time, they must be required to cease operations and be cleared in accordance with the provisions of law.
