According to the Ministry of Industry and Trade , Decree No. 107/2018/ND-CP on rice export business was issued by the Government on August 15, 2018 and took effect from October 1, 2018. Since its issuance, Decree No. 107/2018/ND-CP has been amended and supplemented by Decree No. 01/2025/ND-CP dated January 1, 2025 of the Government.
During nearly 7 years of implementing Decree No. 107/2018/ND-CP and implementing Decree No. 01/2025/ND-CP, rice export business management has achieved many remarkable results. However, in the process of implementing the current Decree, some shortcomings have arisen compared to reality that need to be studied, amended and supplemented.
The draft replacement Decree consists of 5 chapters and 27 articles: Chapter I - General provisions: Includes 3 articles, from Article 1 to Article 3. Chapter II - Conditions for rice export business and Certificate of eligibility for rice export business: Includes 6 articles, from Article 4 to Article 9.
Chapter III - Rice export management: Includes 12 Articles, from Article 10 to Article 21. Chapter IV - Responsibilities of state agencies and related organizations and individuals: Includes 3 Articles, from Article 22 to Article 24. Chapter V - Implementation provisions: Includes 3 Articles, from Article 25 to Article 27.
The content of the draft Decree is built on the principle of reviewing and synchronously and comprehensively adjusting Decree No. 107/2018/ND-CP and Decree No. 01/2025/ND-CP in the direction of removing inappropriate provisions and clauses, creating convenience, transparency, minimizing market entry costs for traders, perfecting the management mechanism, and promoting rice exports.
Specifically, the draft Decree amends post-inspection of rice export business conditions: Post-inspection of rice export business conditions is carried out by the People's Committees at the provincial level to comply with the Law on Organization of the Government .
Amendments to the number of times traders must report according to the provisions of Decree No. 107/2018/ND-CP in the direction of reducing the number of times traders must report, accordingly, traders must make 01 report in a month to create favorable conditions for businesses to implement.
Amendments to the responsibilities of Ministries, branches, and Provincial People's Committees according to the assigned responsibilities in Official Dispatch No. 21/CD-TTg.
Amendments to regulations on designating key traders for transactions in markets with centralized contracts and regulations on allocating centralized contracts to rice export traders for entrusting rice exports.
The draft Decree also adds new contents, such as: Regulations on assessing the creditworthiness of enterprises.
