According to voters in Ho Chi Minh City, types of transportation businesses are not clearly defined, leading to unhealthy competition.
Regulations on business conditions including important devices such as journey monitoring (GSHT) and dash cams are not clear, leading to limited management efficiency. Therefore, voters recommend that the Ministry of Transport take measures to resolve the above problem.
The Ministry of Transport said that the draft Decree detailing road transport activities is expected to be submitted to the Government before October 15, 2024 (illustrative photo).
The Ministry of Transport said that on June 27, 2024, at the 7th Session of the 15th National Assembly , the Road Law was passed, which stipulates types of passenger transport business by car.
These types include: Fixed-route passenger transport business, public passenger transport business by bus, passenger transport business by taxi, contract-based passenger transport business and new types of passenger transport business according to Government regulations.
The Law on Road Traffic Order and Safety also has regulations on GSHT devices and driver image recording devices; regulations on management, operation and use of data management systems to serve the work of ensuring security, order and road traffic safety and handling of violations of the law, and state management of road transport.
In response to voters' comments, the Ministry of Transport will direct research agencies to supplement regulations in the process of drafting the Government's Decree detailing road transport activities (expected to be submitted to the Government before October 15, 2024) and the guiding Circular of the Minister of Transport.
"The agencies of the Ministry of Transport will also coordinate with the agencies of the Ministry of Public Security in the process of developing two legal documents related to GSHT devices and driver image recording devices," the Ministry of Transport emphasized.
According to the investigation of Giao thong Newspaper reporters, the Law on Road Traffic Order and Safety stipulates: Commercial vehicles must be equipped with a GPS tracking device. Commercial vehicles carrying 8 or more passengers (excluding the driver's seat), tractor-trailers, ambulances, and rescue vehicles must be equipped with a GPS tracking device and a device to record the driver's image.
The GSHT device data management system and driver image recording device are used to record, store, and transmit information and data about the journey of vehicles participating in road traffic and images of drivers, serving the work of ensuring security, road traffic safety, handling of law violations, and state management of road transport.
This system is managed, operated and used by the Traffic Police force; connected and shared with road management agencies and relevant agencies.
The Minister of Public Security is responsible for promulgating national technical regulations on road traffic security and safety monitoring systems and national technical regulations on vehicle tracking devices and driver image recording devices.
The Minister of Public Security also regulates the construction, management, operation, exploitation and use of the road traffic security and safety monitoring system, smart devices to support road traffic command and control; regulates the management, operation and use of the GSHT device data management system and driver image recording devices; regulates the equipment, installation, management, operation and use of the technical equipment system for checking the load of motor vehicles.
