Pursuant to Judgment No. 68/2025/DS-PT dated February 27, 2025 and Decision to supplement and amend the appellate judgment No. 18/QD-SCBSBA dated April 2, 2025 of the People's Court of Dak Lak province, on April 4, 2025, the Civil Execution Department of Buon Ma Thuot City (now the Civil Execution Department of Region 1) issued Judgment Execution Decision No. 1712/QD-CCTHADS.

According to the case, Ms. Phuong had previously wanted to build a house and some other structures on her agricultural land. Due to her lack of understanding of legal procedures, she asked Mr. Huy to “stand in her name” to apply for a construction permit. After that, Ms. Phuong completed the procedures to transfer the land use rights to Mr. Huy. However, this transfer was only a sham, without any payment or land transfer.
During the trial, the Court determined that the transfer contract stating the price of 55 million VND for the land lot with an actual value of more than 3.6 billion VND was unreasonable and showed signs of fraud. Witnesses also confirmed that Ms. Phuong was the one who invested the entire project (illegally built on agricultural land) and the crops on the land, while Mr. Huy could not prove that he had contributed.

Dak Lak Provincial People's Court ordered Mr. Huy to return to Ms. Phuong two plots of land (No. 222 and No. 57, map No. 114) with a total area of over 6,200 m² along with all structures and trees on the land. At the same time, Ms. Phuong is responsible for paying Mr. Huy over 306 million VND. After the judgment came into effect, Ms. Phuong paid the full amount and submitted a request for enforcement of the judgment.
During the execution of the sentence, the authorities visited Mr. Huy many times to explain and persuade him to voluntarily fulfill his obligations. However, Mr. Huy did not comply, claiming that he had already submitted a petition.
Therefore, to ensure Ms. Phuong's legitimate rights and the strictness of the law, on July 16, 2025, the Enforcement Officer of the THADS Department of Region 1 issued a decision to enforce. On October 7, the enforcement was organized and the property was handed over to Ms. Phuong in accordance with the Court's judgment.
